항공기 내 이상동기 범죄 대응 관련 법제 개선 연구

This study means to analyze the legal ways to response to abnormal motive crimes occurred on the aircraft in operation. Especially, riots on the aircraft in operation has been considerably increased by 47% in 2022 compared with in 2021 according to the statistic by IATA(International Air Transport Association). The probability of crimes is high because of the environmental characteristic of an aircraft in operation, so the legal responses are very important to deal with them by air carriers as well as the government. Although the international treaty and domestic law such as the Criminal Act, the Air Safety Act, and the Air Security Act, it is still deficient to repose appropriately to abnormal motive crimes. Above all, the legal authorization and responsibility of the aircraft captain and flight crew are not definite. In addition, there is the problem that job training and education to response the crimes on the aircraft in operation are insufficient and protecting flight crew to execute their authorization is inadequate. In this context, this study proposes the alternatives to improve the legislation to response the crimes on the aircraft in operation as follows. First, rapid response through enhancing the authorization of flight crew, second, modifying IFSO(In-Flight Security Officer) regulations, third, legislating for protecting passengers on board the aircraft. Finally, Job training and education system and legal process are needed to be improved to response the crimes on the aircraft in operation adequately.
