우즈베키스탄 신노동법 제정의 국가적·사회적 의의: 신·구 법조문 비교·분석을 중심으로
National and Social Significance of Uzbekistan’s New Labor Code: A Comparative Analysis of the Old and New Provisions

2022년 10월 28일, 우즈베키스탄은 약 30년간 유지되어 온 구노동법을 폐지하고 새로운 노동법을 제정하였다. 기존 법은 변화하는 고용 구조와 노동시장 현실을 충분히 반영하지 못했다는 비판을 받아왔으며, 이에 따라 신노동법은 조문 수를 약 두 배로 늘리고, 근로계약, 분쟁 해결 절차, 취약계층 보호 등에서 실질적 개편을 단행하였다. 이 글은 구노동법 제14장과 제16장의 규범적 특성을 바탕으로 신노동법과의 조문 변화를 비교·분석하여 제도 전환의 구조적 특징과 입법 방향을 도출한다. 고용형태의 다변화, 노동권 보호 주체의 다자화, 절차적 권리 보장의 확대 등 신노동법이 지향하는 핵심 변화에 주목하며, 여성·가족부양자 보호, 외국인 고용 규제, 노동 디지털화 등 주요 조항의 실무적 함의도 검토한다. 마지막으로, 이러한 법제 변화가 한국 기업과 외국인 투자자에게 갖는 전략적 의미를 제시함으로써, 향후 우즈베키스탄 노동환경에 대한 이해를 높이고 양국 간 실질적 협력 기반 마련에 기여하고자 한다.
Abstract
On October 28, 2022, Uzbekistan abolished its Soviet-era Labor Code and enacted a new one, reflecting the evolving dynamics of the labor market. The previous code faced criticism for failing to accommodate modern employment structures and workplace realities. In response, the new Labor Code significantly expanded the number of provisions, introducing detailed regulations on employment contracts, dispute resolution procedures, and protections for vulnerable groups. This study compares and analyzes the normative structure of Chapters 14 and 16 of the old code with the corresponding articles in the new code to identify the structural features and legislative direction of the institutional transition. Particular attention is given to the diversification of employment types, the multilateralization of labor protections, and the enhancement of procedural rights. Practical implications are also discussed in relation to key areas such as protections for women and family providers, foreign labor regulations, and labor market digitalization. By outlining the strategic significance of these legal reforms for Korean companies and foreign investors, this paper seeks to deepen the understanding of Uzbekistan’s labor environment and contribute to strengthening practical cooperation between Korea and Uzbekistan.
