국민건강증진기금의 법적 운영체계 분석과 제도 개선 방향

이 논문은 국민건강증진기금의 법적 운영체계를 구조적으로 분석하고, 제도 개선의 방향을 제시하는 데 목적이 있다. 기금은 건강생활실천과 만성질환 예방, 건강형평성 제고를 위한 재정 수단으로 설계되었으나, 실제 운용에서는 목적성과 일관성이 약화되고 있다. 사용처는 법적으로 폭넓게 규정되어 있지만, 예방 중심 지출의 우선순위 체계가 부재하고, 타 법령 기반의 사업으로 활용이 확장되면서 정책적 정체성이 흐려지고 있다. 또한 기금 조성과 운용 전 과정이 보건복지부에 집중되어 있어 외부 통제 및 평가의 독립성이 미흡하며, 정보공개와 사회적 환류 체계도 제도화되어 있지 않다. 아울러 기금 재원이 담배에 편중된 구조는 흡연율 감소와 재정 안정성 간의 괴리를 초래하고 있다. 이에 본 연구는 기금 사용의 전략적 배분, 감독 체계의 투명성 강화, 재정 기반의 다변화라는 세 가지 방향에서 제도 개편의 필요성을 제시하며, 이를 뒷받침하기 위한 「국민건강증진법」 제23조 및 제25조의 개정, 「주세법」의 연계 개정, 성과 기반 환류체계의 법적 명시 등을 주요한 법제도 개선안으로 제안하였다. 이를 통해 국민건강증진기금이 예방 중심 보건정책의 지속가능한 재정 기반으로 기능할 수 있도록 구체적인 제도적 재설계를 도모하였다.
Abstract
This study seeks to analyze the legal and institutional framework of Korea’s National Health Promotion Fund and propose future policy directions for its reform. While the fund was initially intended to support health promotion, chronic disease prevention, and health equity, its current operations weaken these foundational purposes. Although the legal scope of fund usage is broadly defined, the absence of a strategic prioritization framework and expanding expenditures into projects based on other legislation has diluted the fund’s core identity. Centralized control by the Ministry of Health and Welfare limits external oversight and transparency, while overreliance on tobacco taxes poses risks to fiscal sustainability. To address these challenges, the study suggests institutional reforms in three areas: strategic allocation of resources, transparent governance and evaluation, and diversification of revenue sources. Key legal revisions include amendments to Articles 23 and 25 of the National Health Promotion Act, linkage with the Liquor Tax Act, and legal grounding for a performance-based feedback system. These changes aim to reestablish the fund as a sustainable, prevention-oriented instrument for public health policy.
