본 연구는 특정 시점의 개별 대상자를 전제로 한 현재의 사회적 돌봄정책은 돌봄의 기본적 속성(연속성, 일상성, 다중성)으로 인하여 돌봄 퍼즐과 공백을 해결하지 못한다는 점을 주목하면서, 보편적 돌봄을 전제로 한 정책 방향으로의 전환이 필요함을 제안하는데 목적이 있다. 이를 위해, 본 연구는 현재 법률들이 아동과 노인을 동시에 돌보는 등 돌봄의 연속적이고, 다중적인 특성을 잘 보여주는 이중돌봄의 요구를 수용할 수 있는 내용적 타당성에 기반한 틀거리가 되고 있는가를 비판적으로 검토하여 보고자 한다. 구체적으로, 본 연구는 일하는 근로자들이 이중돌봄 요구가 발생했을 때 가질 수 있는 법적 권리를 담고 있는 ｢남녀고용평등 및 일가족양립 지원에 관한 법률｣을 중심으로 분석하였다. 해당 법률의 ‘일가정양립’ 관련 조항들의 문제를 검토하면서 법률안과 돌봄현실의 간극을 찾아내고, 이를 보완하고 공백을 메울 수 있는 방안을 제시하였다. 결론에서는, 보편적 돌봄의 관점에서 사회적 돌봄정책을 설계해야 함을 강조하였다.
Abstract
The purpose of this study is to propose a shift in policy direction toward universal care, arguing that the current social care framework, which assumes individual subjects at fixed points in time, fails to address the inherent complexities of care, which stem from its continuity, routine, and multi-dimensional nature. To support this argument, this article critically examines whether existing laws provide a valid framework to address the needs of individuals facing “double care” responsibilities, which often requires the persistent, simultaneous and multi-faced tasks, such as caring for both children and elderly family members at the same time. Specifically, this study focused on the “Equal Employment Opportunity and Work-Family Balance Assistance Act,” which outlines the legal rights of employed individuals when confronted with dual care demands. By analyzing the problems of the law’s provisions on ‘work-family balance,’ this study identifies gaps between the legal framework and the realities of care and suggests ways to bridge these shortcomings. In conclusion, it emphasized the necessity of redesigning social care policy from the perspective of universal care.
