A Legal Study on the Protection of Personal Rights in the Digital Society

The rapid development of the digital age presents new challenges and opportunities for the protection of personal rights. This study focuses on exploring the evolution of the concept of personal rights and legal protection in this changing environment, analyzing the legal status of various countries, and seeking ways to protect personal rights suitable for the digital age. First, the methods of collecting, processing, and sharing personal information in the digital environment are aggravating new threats to personal privacy. To address these issues, strict personal information protection regulations such as the European Union's GDPR are gaining attention and are becoming established as global standards. On the other hand, the United States is taking various approaches through different regulations for each state. In addition, the issue of online defamation poses a complex legal challenge in the midst of a conflict with freedom of expression. Each country is establishing legal standards to address these issues and moving toward strengthening the responsibility of platforms. The use of artificial intelligence and big data has the potential to infringe on personal privacy and lead to discriminatory results, and securing transparency and accountability of algorithms is emerging as an important task. The development of virtual reality and augmented reality technologies, while providing users with immersive experiences, also contains the possibility of new violations of personal rights. In this environment, it is urgent to establish legal measures to protect personal information and ensure users’ physical and mental safety. International cooperation and regulatory harmonization are essential elements of protecting personal rights in the digital age, and each country should establish a more consistent protection system through cooperation at the global level. This study aims to present a comprehensive plan for protecting personal rights in the digital environment through various legal and policy analyses, which will contribute to building a safe and fair digital society in the future.
