학교폭력 전담 조사관의 성인지 감수성 제고 필요성과 그 개선 방향에 관한 소고

This paper examines the necessity of enhancing gender sensitivity and improvement directions for school violence specialized investigators, who were introduced as a measure to reduce teachers' workload related to the handling of school violence incidents and ensure the objectivity and fairness of the school violence response system. The system of dedicated school violence investigators, who are external experts independent of school members, holds significant importance as it enables independent investigations of school violence cases, thereby allowing for judgments and measures free from internal conflicts of interest within the school. In particular, investigators, drawing on expertise from diverse fields such as law enforcement, counseling, and education, can contribute to the swift and fair resolution of cases through objective fact-finding. In particular, ensuring gender sensitivity in the school violence investigation process is essential for the effective operation of the system of dedicated school violence investigators. This is because approaching cases of school violence involving sexual violence or gender discrimination without considering the differences in experiences based on socially constructed gender roles can cause secondary harm to victims and lead to the concealment or distortion of the facts. Therefore, specialized investigators for school violence must complete gender sensitivity education and possess the ability to analyze and handle cases from a gender perspective, which serves as a core element in victim protection and human rights-centered investigations. To enhance the gender sensitivity of school violence investigators, the following improvement measures are proposed: first, establishing a customized, practice-oriented gender sensitivity education system; second, revising relevant laws and regulations to establish the legal status of specialized investigators and mandate related education; and third, providing sustainable human and financial resources. Going forward, we hope that discussions will continue to establish directions and strategies for enhancing the capabilities of specialized investigators, so that the system of specialized investigators for school violence can play an important role in restoring trust in educational settings, ensuring student rights, and protecting victims from a gender equality perspective, beyond merely performing investigative functions.
