플라스틱협약 채택을 위한 논의 동향과 법적 과제

플라스틱오염이 전 지구적 차원의 복합적 위험을 야기한다는 인식이 확산됨에 따라, 국제사회는 이를 보다 구조적으로 해결하기 위한 논의에 착수하게 되었다. 2022년 제5차 유엔환경총회에서는 플라스틱 염에 대응하기 위한 법적 구속력 있는 국제협약을 채택하기로 결의하였고, 이에 따라 정부간 협상위원회(INCs)가 출범하여 2022년부터 2024년까지 다섯 차례에 걸친 협상이 이어졌다. 그러나 2024년 말 부산에서 개최된 INC-5에서도 플라스틱 생산 감축, 화학물질 규제, 재정 및 기술지원 메커니즘 등을 둘러싼 국가 간 입장 차로 협약 채택은 무산되었다. 그렇지만, INC-5 마지막 날 의장문서(Chair’s Text)가 제안되어 향후 협상의 기초가 마련되었으며, 2025년 8월 스위스 제네바에서 재개될 INC-5.2에서 논의가 이어질 예정이다. 이 글은 플라스틱협약의 채택 논의동향을 살펴보고, 향후 협약 채택과 관련하여 법적 검토가 필요한 과제를 짚어보는 것을 목적으로 하고 있다. 이를 위하여 먼저 2022년부터 2024년까지 진행된 INC에서의 논의를 중심으로 협상 경과를 정리하고, 향후 협상의 기초문서 역할을 하게 될 의장문서의 주요내용을 분석함에 이어서, 각각의 쟁점에 대한 평가와 전망을 보태어 향후 협약 채택과 관련하여 고려가 필요한 사항을 제시하고 있다. 의장문서는 비록 250여 개의 괄호 표기가 남아 있기는 하지만, 생산감축, 재정, 제품 및 화학물질 관련 쟁점 외에는 전체적인 구조가 완성된 형태의 협상문서로 구성되었고, INC-5에서 핵심 쟁점에 대한 각국의 입장이 구체적으로 확인되었기 때문에 향후 협상에서는 절충안을 중심으로 논의할 수 있는 기반이 조성되었다고 할 수 있다. 그렇지만, 플라스틱과 플라스틱제품의 생산에 관한 제3조와 제6조, 그리고 재정지원에 관한 제11조를 둘러싸고는 국가 간 의견이 여전히 평행선을 달리고 있다. 플라스틱협약 협상의 기초를 제공한 UNEA 결의안에서 플라스틱의 전 생애주기를 포괄하는 법적으로 구속력 있는 국제협약의 채택을 요구한 것이니만큼, 플라스틱의 전 생애주기를 다루는 포괄적인 접근방식을 협약의 목적으로 수용하여야 함은 물론, 사전배려원칙에 기반한 플라스틱의 생산 감축과 플라스틱제품의 단계적 퇴출을 내용으로 포함하는 협약으로 성안되어야 할 것이다. 이를 포기한다면 플라스틱협약을 살릴 수 있을지는 몰라도, 플라스틱으로 병든 지구는 살릴 수 없을 것임을 명심하여야 할 것이다.
Abstract
As awareness grows that plastic pollution poses complex and global threats—including to human health, biodiversity, food security, and climate systems—the international community has embarked on efforts to establish a more structured and legally binding solution. At the resumed fifth session of the United Nations Environment Assembly (UNEA‑5.2) in March 2022, a historic resolution was adopted to develop an international legally binding instrument to end plastic pollution, including in the marine environment. This led to the establishment of the Intergovernmental Negotiating Committee (INC), which held five sessions from 2022 to 2024. Despite extensive deliberations, INC-5, held in Busan in late 2024, failed to reach consensus due to deep divergences over plastic production reduction, regulation of chemicals of concern, and mechanisms for financial and technical assistance. Nevertheless, on the final day of INC-5, the Chair’s Text was introduced as a consolidated negotiating text and now serves as the basis for future discussions. Negotiations are scheduled to resume at INC‑5.2, to be held in Geneva, Switzerland, from August 5 to 14, 2025. This paper examines the trajectory of treaty negotiations, analyzes the key structure and provisions of the Chair’s Text, and identifies major legal challenges that must be addressed in upcoming sessions. Although the Chair’s Text still contains approximately 250 bracketed provisions, it represents a nearly complete draft except on the core issues of production reduction (Articles 3 and 6), financial support (Article 11), and chemical regulation. States’ positions on these issues have been clarified, laying the groundwork for compromise-driven negotiations at INC‑5.2. The paper argues that, in line with the mandate from UNEA‑5.2, the Plastics Treaty must adopt a comprehensive life-cycle approach. Furthermore, it must include legally binding commitments to reduce plastic production and phase out plastic products, grounded in the precautionary principle. Without these commitments, the treaty might be procedurally adopted but would fail to deliver on its substantive goals—saving the treaty, but not the planet.
