식품위생법상 반려동물 동반 출입 허용 범위에 관한 제언 - 미국과의 비교를 중심으로 -

반려동물을 사람처럼 대하고 가족으로 생각하는 펫 휴머니제이션(Pet+Humanization) 현상과 펫팸족(Pet+Family)들이 늘어나면서 반려동물과 동반하여 여행, 숙박, 음식점, 까페 등 어디든지 함께하려는 반려인들도 늘어나고 있다. 그러나 ｢식품위생법｣상 식품접객업을 영위하는 시설에는 원칙적으로 반려동물 동반 출입이 금지되고, 위반 시 행정처분이나 벌칙에 처해질 수 있음에도 불구하고, 반려동물 소유자나 영업자는 이를 잘 인지하지 못하여 위법행위를 하게 되는 문제점이 발생하고 있다. 최근 정부에서도 일정 조건 하에서 규제의 전부나 일부를 적용하지 않도록 하여 반려동물 연관 산업과 반려인, 반려동물, 영업자들에 대한 무조건적인 규제가 아니라 시장 진입을 지원하기 위한 규제샌드박스 제도의 운영을 통해 반려동물 동반 출입을 허용하고 있다. 또한 식품의약품안전처는 ｢식품위생법 시행규칙｣ 일부 개정안을 입법예고(식약처 공고 제2025-182호) 하여 반려동물 동반 출입을 허용하는 시설기준과 영업자 준수사항을 발표하였다. 비교법적으로 미국에서는 식품 관련 규제를 연방정부의 모델 규범인 ‘식품규정(Food Code)’을 통해 관리한다. 해당 규정 §6-501.115는 식품, 깨끗한 장비, 기구 및 린넨류, 포장되지 않은 개인용 일회용품 등이 오염될 가능성이 없을 경우에 한해, 일정 조건에서만 살아있는 동물(식재료로 사용되는 동물 제외)이 음식점 등에 출입할 수 있도록 하고 있었으나, 지난 2022년 12월에 §6-501.115의 동물 출입 금지 조항에 예외 조문(D)을 추가하여 규제 당국의 승인을 받은 경우에 한해 야외 식사 공간에서 반려동물의 출입을 허용할 수 있도록 개정하였다. 각 주(state) 및 시(city)에서는 이를 참고해 자체적인 법체계를 구축 및 반려견 출입 허용 범위를 정하고 있다. 본 연구에서는 국내의 반려동물 동반 출입과 제한에 대한 ｢식품위생법｣상 규제 및 규제샌드박스 운영 사례와 ｢식품위생법 시행규칙｣ 입법예고안을 검토하고, 미국의 반려견 동반 출입 허용 범위에 대한 입법례를 분석하여 국내법상 반려동물 동반 출입 허용 범위의 확대 및 관련 규정의 도입 가능성을 제언하였다.
Abstract
With the rise of the “pet humanization” phenomenon, where people treat their pets like family members, and the growth of the “pet family” trend, the number of pet owners bringing their pets along on trips and into hotels, restaurants, cafes, and other places is steadily increasing. However, despite the Food Sanitation Act, which prohibits pets from entering food service establishments and stipulates that violations may result in administrative sanctions or penalties, many pet owners and business operators remain unaware of these rules and often engage in prohibited practices. Recently, the government has implemented a regulatory sandbox system to support market entry, rather than simply restricting the pet industry, pet owners, and businesses. This system provides a framework under which pets may be permitted in certain establishments. Furthermore, the Ministry of Food and Drug Safety has announced a partial revision to the “Enforcement Rule of the Food Sanitation Act”, setting forth facility standards for allowing pets as well as compliance obligations for business operators.
