플랫폼 기반 교권 보호 대응체계의 기술-법 융합 모형 연구: 디지털 교육환경에서의 정책 적용 가능성 분석
A Converged Techno-Legal Framework for Platform-Based Teacher Rights Protection: Analyzing Policy Applicability in the Digital Education Environment

본 연구는 디지털 전환이 심화된 교육환경 속에서 교사의 권리가 온라인 기반에서 다양한 방식으로 침해당하고 있는 현실을 문제의식으로 삼아, 기존 법제 중심의 대응 체계를 보완할 수 있는 기술-법 융합 기반 교권 보호 체계의 구축 가능성을 탐색하였다. 특히, SNS·온라인 커뮤니티·실시간 평가 시스템 등을 매개로 한 교사 비방, 허위정보 유포, AI 기반 음성 및 영상 합성 등 새로운 유형의 디지털 교권 침해가 증가함에 따라, 실질적이고 지속가능한 대응체계의 필요성이 대두되고 있다. 본 연구는 서울시교육청의 ‘e-교권 신고시스템’을 비롯하여, 독일(BMBF)의 Lehrkraftschutz, 일본 문부과학성의 ‘스마트 스쿨 안전시스템’, 영국 교육부의 Behaviour in Schools Toolkit을 비교 사례로 설정하고, 문헌조사, 교사 대상 설문조사(N=150), 전문가 초점집단면담(FGI)을 병행하였다. 분석 결과, 실효성 있는 교권 보호 플랫폼은 단순한 신고 기능을 넘어 실시간 감지, 디지털 증거 자동 수집, 법률·심리지원 연계, 데이터 기반 정책 피드백 기능을 갖춰야 하며, 개인정보 보호, 정당행위 기준의 명확화, 증거능력 확보 등을 포함한 법적 기반이 병행되어야 함이 확인되었다. 이에 본 연구는 기술-법 융합 관점에서 실시간 대응 체계와 제도 연계 구조를 아우르는 대안적 플랫폼 모형을 제시하고, 향후 ｢교원지위법｣의 디지털 환경 반영, 플랫폼 인증제 도입, 교육청 단위 실천 전략 마련 등 정책적 연계 방안을 제안한다. 본 연구는 교권 보호를 위한 플랫폼이 단순한 사후 대응 도구를 넘어, 디지털 교육 거버넌스의 핵심 인프라로 자리매김할 수 있음을 이론적·실증적으로 제시하였다는 점에서 의의를 갖는다.
Abstract
Research Purpose: This study investigates the development of a techno-legal framework to protect teacher rights through a platform-based response system in the digital education environment. As digital learning expands rapidly, new forms of teacher rights violations—such as online harassment, unregulated feedback systems, and inadequate administrative support—have emerged as pressing challenges. Research Methods: The study employs qualitative content analysis focusing on the 2023 amendments to the Teacher Status Act and related education laws. It also includes comparative case analyses of platform-based teacher protection systems in the United Kingdom, Germany, and Japan. Additionally, expert interviews with legal scholars and field educators were conducted to assess the practical feasibility of technology-driven protective measures. Results in Research: Findings indicate that existing legal protections remain insufficiently responsive to digital threats and that most schools lack integrated technological tools to support teacher protection. Case studies highlight the potential of digital platforms to enhance documentation, verification, and resolution processes. However, legal uncertainties regarding data usage, admissibility of digital evidence, and privacy protections remain key obstacles. Research Conclusion: This research proposes a techno-legal convergence model that integrates legal frameworks with platform technologies to strengthen institutional responses to teacher rights violations. The study recommends policy innovations, including AI-supported evidence tracking, integrated digital complaint systems, and comprehensive training for educators in digital rights protection.
