가정폭력에 대한 정당방위의 비교법적 검토 -2024년 한국형사법학회의 형법 개정안을 계기로

형법 제정 이후 약 70년을 넘기며 21차례의 부분 개정이 이루어졌지만 전면 개정에는 실패해왔다. 본 연구는 한국형사법학회에서 2024년 공표한 개정안을 향후 본격적으로 논의하는데조금이나마 도움이 되고자 약간의 비교법적 검토를 더하고자 하였다. 구체적인 소재로서 정당방위 규정을 선택하였는데 우리 형법의 정당방위 규정은 다른 나라와상당한 차이를 보이고 있을 뿐만 아니라 개정 논의 자체가 거의 없기 때문이다. 정당방위 자체도 매우 광범위한 쟁점을 포함하고 있기에 우선 우리나라에서 주로 논의되는쟁점의 하나인 가정폭력에 대한 정당방위로 한정하였다. 독일과 일본의 논의와 판례가 중요한데 이와 관련 일본에서는 가정폭력에 대한 정당방위 규정의 해석 및 적용이 독일보다는 미국에친화적이라고 평가받고 있으므로 미국의 논의와 판례도 같이 살펴보았다형법상 정당방위 관련 규정이 비교적 체계적으로 규정되어 있음에도 정당방위가 제대로 인정되지 않는 우리나라와 달리 각 나라들은 각자의 기준을 활용하여 정당방위를 나름대로 인정하고있음을 알 수 있었다.
Abstract
In the 70 years since its enactment, the Korean Penal Code has been partially revised 21 times, but has failed to be fully revised. This study aims to add a little comparative legal review to help the Korean Criminal Justice Association discuss the proposed revision in 2024. I chose self-defense as a specific topic because the self-defense provisions of Korean criminal law are not only significantly different from those of other countries, but also because there has been little discussion of revision. Since self-defense itself encompasses a very broad range of issues, we first limited ourselves to self-defense against domestic violence, which is one of the most discussed issues in Korea. The discussions and precedents of Germany and Japan are important in this regard, as Japan's interpretation and application of the self-defense against domestic violence is considered to be more friendly to the United States than Germany's, so we also examined the discussions and precedents of the United States. Unlike Korea, where self-defense is not recognized properly despite the relatively systematic provisions on self-defense in the criminal law, we found that each country recognizes self-defense in its own way using its own criteria.
