역할 분석을 통한 탐정 업무의 법제화 방향 논의:저작권 전문탐정 사례

According to the Global Music Report 2022, 28% of the respondents use pirated copies uploaded through downloadable streaming ripping. The Copyright White Paper 2022 of the Korea Copyright Commission reports that the number of infringements on the reproduction and transmission rights of musical works reached 1.06 billion in Korea after 2019. Above all, the scope and methods of copyright infringement has continued to be sophisticated. In this context, this study examines the roles of copyright detectives in response to the demand for copyright security, and analyzes the influence of the roles of private detectives (PDs) on market demand of PDs. The AHP results show that three prioritized roles of copyright detectives among nine ones are ‘investigation of infringed property for damages lawsuits,’ ‘identification of infringer and assessment of the amount of damages’, and ‘initial evidence collection for civil and criminal lawsuits’. More importantly, the Logistic Regression Analysis reports that those three pivotal roles have impact on the demand for PDs by music copyright holders. These results imply that a Bill of Private Detectives should rule the specific roles of PDs, including collecting evidence and investigating damages required for the legal response process.
