모의선거 실천을 위한 제도 개선 방안

이 연구는 그동안 수행된 모의선거 연구를 종합하고, 공통된 문제인식을 확인한 후 향후 과제를 제안하는 것을 목적으로 한다. 선행연구들은 모의선거가 우리나라 정치교육의 내실화와 질적 개선을 위해 효과적인 학습 방법이라고 주장한다. 그러나 현실적으로 학교에서 모의선거를 실시하는 것은 매우 어렵다. 헌법과 교육기본법, 공직선거법의 교육 중립성 관련 조항들이 교사들에게 압력으로 작용하고 있고, 선거관리위원회의 엄격한 해석 역시 모의선거를 주저하게 만들기 때문이다. 그래서 우리나라에서는 시민단체가 주도하는 모의선거 외에는 아직 널리 활용되는 모의선거 모델이 만들어지지 않았다. 이 연구는 시민단체 주도형 모델 외에 대학과 연구기관이 연구 목적으로 실시하는 방안, 중앙선거관리위원회가 모의선거를 관리하는 방안, 법규 개정 후 학교가 자율적으로 모의선거를 실시하는 방안 등을 대안으로 제시하였다. 각각의 방안들이 갖는 장단점이 있지만, 장기적으로는 학교가 교육활동으로써 모의선거를 수행할 수 있도록 법적 근거를 마련해 주는 것이 최선이다.
Abstract
This study aims to propose future directions for the improvement of mock election practices by analyzing both domestic and international cases and critically assessing the current conditions for implementing mock elections in South Korea. The implementation of mock elections faces significant legal and institutional constraints, which hinder their widespread adoption. Apart from NGO-led mock elections, a standardized and universally applicable model for mock elections has yet to be established. Although the National Election Commission has conducted some mock election programs, their scope remains limited. In the long term, establishing a clear legal foundation that allows schools to implement mock elections as part of formal educational activities is essential for ensuring their sustainability and effectiveness.
