사회과에서의 헌법교육이 법의식에 미치는 영향: 초등 5학년 학생을 중심으로

이 연구의 목적은 헌법교육이 초등학생의 법의식 함양에 미치는 영향을 실증적으로 분석하는 데 있다. 이를 위해 초등학교 5학년 학생 100명을 실험집단(50명)과 통제집단(50명)으로 구성하고, 이 연구에서 개발한 10차시 헌법교육 프로그램을 실험집단에 적용하였다. 법의식은 인지, 기능, 정서, 행동의 네 차원으로 구성하였으며, 법의식 변화 양상을 분석하기 위해 사전-사후 설문을 공분산분석(ANCOVA)으로 진행하였다. 또한 학습지, 소감문, 산출물 등을 활용한 면담을 병행함으로써 양적 결과를 심층적으로 해석하고, 측정 수치에 드러나지 않은 학생들의 내면적 변화와 해석을 보완하였다. 연구 결과, 헌법교육은 초등학생의 법의식(네 차원) 함양에 긍정적인 영향을 끼치는 것으로 나타났으며, 이를 통해 헌법교육의 교육적 가치와 정당성을 재조명할 수 있었다. 아울러 헌법교육에서 학년 발달에 맞는 단계적 내용 구성의 필요성, 기능적 요소를 반영하기 위한 다양한 맥락을 반영한 수업 설계의 중요성, 정서적 공감을 유도하는 교수-학습 전략의 필요성 등의 교육적 시사점을 도출함으로써 헌법교육의 실천 가능성과 교육과정 개선의 방향을 제시하였다.
Abstract
The purpose of this study is to empirically examine the impact of constitutional education on the development of legal consciousness among elementary school students. To achieve this, a constitutional education program consisting of 10 sessions was developed and applied to an experimental group of 50 fifth-grade students, while another 50 students formed the control group. Legal consciousness was conceptualized into four dimensions: cognitive, functional, affective, and behavioral. The changes in students' legal consciousness were analyzed using analysis of covariance (ANCOVA) based on pre- and post-survey results. In addition, in-depth interviews were conducted using student worksheets, reflection journals, and learning artifacts to interpret the quantitative results more comprehensively and to identify internal changes not captured by numerical data. The results demonstrated that the constitutional education program had a positive effect on the enhancement of students' legal consciousness across all four dimensions. These findings reaffirm the educational value and justification of constitutional education within elementary legal education. This research contributes foundational insights for redefining the role and structure of constitutional education in elementary social studies curricula.
