EU의 탄소 관련 공급망정책과 영업비밀 보호에 관한 연구

This Study tries to explain the legal and policy aspects raised by trade secret with regards to increasingly strict global supply chain policies, particularly for carbon control and the escalation of ESG-driven mangement. The U.S-China trade conflicts, pandemic and competition for technical supremacy have urged global supply chain more conplicated. As a result, major economic countries tried various kinds of new regulatory regime related to carbon control to tackle climate crisis. While these carbon-related measures promote sustainable development in business side, they are highly likely forcing disclosure of trade secret and thus, cause potential conflicts with protection of trade secret. As a result of analyzing trade agreements and various domestic regulations in major economies, this study finds the constraints of international trade agreements and national laws related to trade secret in tackling challenges raised by global supply chain policies related to carbon reductions. In summary, carbon-focused global supply chain polices are essential in addressing climate crisis. But establishing a balanced framework that protects trade secret while ensuring regulatory framework is needed.
