누스바움의 『동물을 위한 정의』 읽기: 서구 이성중심주의의 잔재를 비판하며

누스바움(Nussbaum)은 2023년 역량접근법을 동물에 적용하는 『동물을 위한 정의』를 출간했다. 지금까지 동물 복지 또는 동물권 논의의 토대가 되어 온 피터 싱어의 『동물해방』의 공리주의적 토대를 뛰어넘는 사상으로, 동물권의 새로운 고전이 될 것이라는 평가를 받는 책이다. 동물을 존엄성을 지녔으며 자신의 특수한 삶의 형태를 온전히 존중받아야 하는 동료 ‘시민’으로 제시하는 그녀의 동물 이해는 분명 이전의 서구 철학에서의 동물 이해와는 현격한 차이가 있는 발전으로 보인다. 그러나 그녀의 사상을 촘촘히 따라가면서, 그녀가 구상하고 있는 ‘다종적 법공동체’가 여전히 자유주의 전통 속 이성중심주의의 잔재를 해결하지 못하고 있는 부분을 발견하게 되었다. 그 한계로 인해, 그녀가 역량접근법 이론을 현실에 적용하며 그려내는 세계는 반려동물뿐 아니라 야생동마저도 인간이 만들어낸 ‘자본주의 기술산업문명’에 종속되는 디스토피아적 가능성을 품고 있다. 그 미래가 지금은 아직 기술적으로 실현이 불가능하지만 생명공학의 발전 속도를 생각해보면 불가능한 미래는 아닐 수 있기에, 동물권과 동물윤리에 대하여 새로운 지평을 열은 책, 고전이 될 책으로 추앙받는 책의 세계관이 여전히 낡고 폭력적인 패러다임 속에 있는 것은 아닌지 검토할 필요성을 느끼게 된다. 이에 이 글에서는 누스바움의 새로운 동물 이해와 동물을 위한 정의로서 역량접근법을 간략히 소개하고, 그녀의 이론적 접근에 대하여 가지게 되었던 우려의 지점들을 제시해 본다(II). 그리고 그녀가 자신의 이론을 반려동물(III)과 야생동물(IV)에 적용한 결과를 구체적으로 살펴보면서 그 우려를 좀더 깊이 탐색해본다. III.에서는 노예와 시민이 양립불가능한 개념임에도 그 부분이 반려동물의 문제에 있어서는 눈감아지고 있는 모순성을 지적하고, IV.에서는 누스바움의 자연과 야생에 대한 이해에 여전히 인간·이성중심적인 태도가 도사리고 있음을 확인하고 그 위험성을 다루어본다. 이 고찰은 생태주의적 방향성을 가지나 생태주의적 주장을 전면에 내세워 다루지는 않으며, 누스바움의 사상의 무의식적 배후에 여전히 잔존하는 서구적인 이성중심주의의 한계를 드러내는 것을 주된 목적으로 한다. ‘자연을 정의로 대체’하자는 누스바움의 주장은 그 정의가 인간의 관점에서의 정의라는 점에서 큰 문제가 있다.
Abstract
In 2023, Martha Nussbaum published Justice for Animals, in which she applies her capabilities approach to animals. This book has been hailed as a new classic in the field of animal rights, offering a philosophical foundation that surpasses the utilitarian basis of Peter Singer’s Animal Liberation, which has long served as a cornerstone for discussions on animal welfare and rights. Nussbaum presents animals as fellow “citizens” endowed with dignity, whose distinctive forms of life deserve full respect―marking a significant departure from the traditional understanding of animals in Western philosophy. However, a close examination of her thought reveals that her vision of a “multi-species legal community” still fails to escape the residue of rationality-centered liberalism. This limitation suggests that the world she envisions, applying the capabilities approach to reality, carries a dystopian potential in which not only companion animals but even wild animals are ultimately subordinated to humanity’s “capitalist, techno-industrial civilization.” Although this future may seem technologically unfeasible today, considering the rapid pace of biotechnological advancement, it may not be an impossible one. This raises the question of whether this widely praised book―one that opens up a new horizon for animal rights and ethics―might in fact remain entrenched in an outdated and violent paradigm. Accordingly, this paper begins by briefly introducing Nussbaum’s novel understanding of animals and her use of the capabilities approach as a framework for justice for animals (Section II). It then identifies and examines points of concern that arise from her theoretical framework. Section III explores her application of the theory to companion animals, highlighting a contradiction in which the mutually exclusive concepts of slave and citizen are overlooked. Section IV focuses on her views on nature and wild animals, revealing a lingering anthropocentric and rationalist attitude that poses significant risks. While this analysis is informed by an ecological perspective, it does not forefront ecological arguments; rather, it seeks to expose the limitations of Western reason-centered thinking that unconsciously persist in Nussbaum’s work. Her proposal to ‘supplant nature with justice’ is deeply problematic, as the justice she envisions is one defined strictly from a human standpoint.
