행정사법인을 합명회사로만 설립할 수 있게 규정한 현행 「행정사법」의 비판적 검토 - 「행정사법」 제25조의13 제2항을 바탕으로 -

복잡하고 다양한 행정 수요 증가에 대응하여 전문적인 행정사 서비스를 제공하고 행정사 서비스의 공신력 향상을 위하여 2021년 6월 설립이 허용된 행정사법인은 무한책임인 합명회사의 형태로만 설립이 가능하다. 이에 따라 행정사법인을 합명회사로만 설립할 수 있게 규정한 현행 「행정사법」제25조의13 제2항은 행정사들의 「대한민국헌법」제15조의 직업수행의 자유 중 기업(영업)의 자유, 동법 제21조제1항의 결사의 자유, 동법 제11조 제1항의 평등권에 기한 자의금지의 원칙을 현저히 침해한다. 행정사들이 국민의 행정편익과 행정제도의 발전이라는 공공복리를 달성하기 위해서는 현행 행정사법인 제도에 대한 개편이 필요하다. 행정사들에 무한책임이라는 굴레를 씌우는 것이 공공복리를 위한 것이 아니라 행정사들에 유한책임과 무한책임을 선택하여 합자회사로 행정사법인을 설립할 수 있게 해 주는 것이 공공복리를 위한 것이라는 발상의 전환이 필요하다. 행정사법인을 합자회사로 설립이 가능하면 의뢰인의 재산권과 손해배상청구권을 더욱 두텁게 보호 가능하고, 행정사법인의 공신력 확보를 통한 행정사법인의 증대와 이를 통한 행정사들의 수익 증진이 가능해지고, 국민의 행정편익 증진을 통한 행정사제도와 행정제도의 발전을 함께 이룰 수 있게 된다. 이에 따라 본고에서는 행정사법인을 합명회사로만 설립할 수 있게 하는 근거 규정인 현행 「행정사법」제25조의13 제2항을 고찰하여 개선 방안을 제시할 것이다. 이를 위하여 「행정사법」제25조의13 제2항이 「대한민국헌법」제15조의 직업선택의 자유를 위반하는지 여부(Ⅱ.), 「행정사법」제25조의13 제2항이 「대한민국헌법」제21조 제1항의 결사의 자유를 위반하는지 여부(Ⅲ.), 「행정사법」제25조의13 제2항이 「대한민국헌법」제11조 제1항의 평등권을 침해하는지 여부(Ⅳ.)를 고찰하여 결론을 맺을(Ⅴ.) 것이다.
Abstract
In order to respond to the increase in complex and diverse administrative demands, provide professional administrative services, and enhance the credibility of administrative services, administrative law firms that were permitted to be established in June 2021 can only be established in the form of general partnerships with unlimited liability. Accordingly, Article 25-13, Paragraph 2 of the current Administrative Attorney Act, which stipulates that administrative law firms can only be established as general partnerships, significantly violates the freedom of enterprise (business) among the freedom of administrative firms to practice their profession under Article 15 of the Constitution of the Republic of Korea, the freedom of association under Article 21, Paragraph 1 of the same Act, and the principle of prohibition of arbitrariness based on the right to equality under Article 11, Paragraph 1 of the same Act. In order for administrative attorneys to achieve public welfare, such as the people's administrative convenience and the development of the administrative system, the current administrative law firms system needs to be reformed. It is necessary to change the way of thinking that putting the shackles of unlimited liability on administrative attorneys is not for the public welfare, but rather allowing administrative attorneys to establish administrative law firms as partnerships by choosing between limited and unlimited liability is for the public welfare. If administrative law firms are established as limited partnerships, the property rights and damages claims of clients can be more thoroughly protected, and the credibility of administrative law firms can be secured, thereby increasing the number of administrative law firms and increasing the profits of administrative law firms. In addition, the administrative law system and the administrative system can be developed together by increasing the administrative convenience of the people. Accordingly, this paper will examine Article 25-13, Paragraph 2 of the current Administrative Attorneys Act, which is the basis for establishing administrative law firms only as general partnerships, and suggest improvement measures. To this end, we will examine whether Article 25-13, Paragraph 2 of the Administrative Attorney Act violates the freedom of occupational choice under Article 15 of the Constitution of the Republic of Korea (II.), whether Article 25-13, Paragraph 2 of the Administrative Attorney Act violates the freedom of association under Article 21, Paragraph 1 of the Constitution of the Republic of Korea (III.), and whether Article 25-13, Paragraph 2 of the Administrative Attorney Act violates the right to equality under Article 11, Paragraph 1 of the Constitution of the Republic of Korea (IV.), and conclude (V.).
