개인정보 전송요구권의 시행에 관한 법제적 고찰

‘全 분야 마이데이터’ 실현을 위한 법적 기반인 개인정보 전송요구권이 2025년 3월 13일 시행되었다. 개인정보 보호법 제35조의2는 개인정보 전송요구권을 규정하고 있으나, 구체적인 내용은 하위법령에 위임하고 있다. 개인정보 보호법 시행령에서는 개인정보 전송요구를 받고 해당 개인정보를 전송하는 개인정보처리자를 보건의료정보전송자, 통신정보전송자, 에너지정보전송자로 구분하고 있다. 보건의료정보와 통신정보에 대한 전송요구권은 2025년 3월 13일에 시행되었지만, 에너지정보에 대한 전송요구권은 2026년 6월 1일까지 유예되었다. 즉, 全 분야 마이데이터 실현을 위한 법적 근거는 어느 정도 마련된 것으로 보이지만, 이와 함께 기술적·제도적 기반도 마련되어야 할 것이며, 사회 구성원 전반의 인식과 공감도 확보될 필요가 있다. 이러한 배경에서 본고에서는 ‘개인정보 전송요구권’이 개인정보 보호법에 신설되는 입법 경과를 살펴보고, 개인정보 보호법과 같은 법 시행령에서 규정하고 있는 구체적인 ‘개인정보 전송요구권’의 내용과 법리적·법제적 쟁점을 자세히 살펴본다. 아울러, 법률에서 대통령령으로 포괄적으로 위임한 사항의 적절성, 전송의무를 부담하게 되는 개인정보처리자의 기준 및 범위, 전송요구의 실효성 확보를 위한 벌칙(과태료) 규정 신설 등 개인정보 전송요구권의 성공적인 시행을 위해 필요한 입법과제에 대해서도 살펴보고 대안을 제시한다.
Abstract
On March 13, 2025, the right to request the transfer of personal information, the legal basis for the realization of 'My Data in all fields', came into effect. Article 35(2) of the Personal Information Protection Act stipulates the right to request the transfer of personal information, but the specific details are delegated to subordinate laws. In particular, the Enforcement Decree of the Personal Information Protection Act categorizes personal information processors who receive a request to transmit personal information and transmit such personal information into healthcare information transmitters, telecommunication information transmitters, and energy information transmitters. The right to request the transmission of healthcare information and telecommunication information came into effect on March 13, 2025, but the right to request the transmission of energy information was suspended until June 1, 2026. The Personal Information Protection Commission has implemented the Notification on the Transmission of Personal Information in the Telecommunications Sector and the Notification on the Transmission of Personal Information in the Healthcare Sector, but the Notification on the Transmission of Personal Information in the Energy Sector has been suspended until June 1, 2026. Although the legal basis for the realization of Mydata in all fields has been established, it is necessary to secure technical and institutional foundations and social consensus. Against this backdrop, this article examines the legislative progress of the 'Right to Request Personal Information' in the Personal Information Protection Act, and details the specific contents of the 'Right to Request Personal Information' stipulated in the Enforcement Decree of the same Act.
