초록
우주상황인식(SSA)은 우주 활동의 안전을 보장하고 우주를 안전하고 지속·가능하게 만드는데, 중요한 역할을 한다. 특히 뉴스페이스 시대를 맞이하여 국가들의 허락을 받은 우주기업체들이 근지구 우주공간(near-Earth space)을 빈번하게 사용함에 따라 SSA는 그 중요성이 점점 커지고 있다. 현재 운영 중인 우주물체뿐만 아니라 증가하는 우주쓰레기를 감지, 식별, 모니터링하고, 업데이트하는 작업에는 국제협력이 매우 중요하기 때문이다. 그러나 국가 간 SSA 데이터 및 정보교환에 대한 국제협력은 국가간 협력협정 내지는 양해각서(MOU)에 의존하고 있다. 세계의 모든 우주물체에 대한 정확한 인식을 달성하기 위해 어떤 국가도 단순히 자국의 노력에만 의존할 수 없기 때문에 국제사회가 SSA 데이터를 공유할 필요가 있다. 1967년 우주조약(OST) 초안을 작성할 때 협력(cooperation)이라는 용어는 우주활동에만 국한되었으며, 보조 정보 서비스나 부가 서비스 제공 산업에 적용하려는 의도는 아니었다. 사실 SSA 시스템은 특히 국가의 이해관계가 서로 얽혀서 국제관계에서 구현되기 어렵다는 점인데, OST나 다른 기존의 구속력 있는 우주관련조약도 SSA 데이터의 공개 및 공유 의무를 규정하고 있지 않다. 따라서 우주교통관리(STM)를 위한 소스 및 기반과 신뢰할 수 있고 정확한 상황 판단을 제공할 수 있는 통합 SSA 시스템을 위한 국제적인 조정 메커니즘(international coordination mechanism)을 구축의 필요성이 제기되고 있는 것이다. 유엔 우주의 평화적 이용위원회(UNCOPUOS)의 과학기술소위원회(STSC)는 2019년 “우주활동 장기지속가능성 가이드라인”을 통하여 SSA에 대한 지원을 언급하고 있으나, UNCOPUOS의 법률소위원회(LSC)에서 SSA 조항을 포함하는 가이드라인이 제안되어야 할 필요가 있다. 이 가이드라인에는 우주쓰레기가 생성될 때마다 책임 있는 국가는 우주비행을 하는 다른 국가에게 해당 우주쓰레기에 대한 통지와 정보를 제공해야 하며, 정보교환에는 우주쓰레기의 위치와 크기, 파편이 통과할 수 있는 잠재적인 궤도 경로가 포함되어야 할 것이다. 만일 UNCOPUOS의 LSC에서 SSA에 관한 가이드라인이 만들어 진다면, 비록 연성법적인 의무일지라도 이 영역에서 필요한 안정성을 추가할 것이고, 또한 SSA의 국제협력은 SSA가 구성 요소가 될 STM에서 보다 정교한 미래의 우주활동을 위한 디딤돌이 될 수 있을 것이다.
Abstract
Space Situational Awareness (SSA) plays an important role in ensuring that space activities proceed safely by domestic and international laws, standards and other norms. This means understanding the space environment and recognizing threats to space activities. Accurate information on the location and surroundings of satellites and/or space debris is critical to the safety and security of space activities. In particular, the US military currently operates the most advanced SSA system in the world, and the US national law and policy have repeatedly encouraged and increased SSA data sharing requirements. There is a need for the international community to share SSA data because no country can simply rely on its efforts to achieve accurate recognition of all space objects in the world. The SSA system is difficult to implement, especially in international relations where states have divergent national interests. When drafting the 1967 Outer Space Treaty (OST), cooperation was limited to space activities and was not intended to apply to ancillary information services or industries providing value-added services. Neither the OST nor other existing binding space-related treaties stipulate the obligation to disclose and share SSA data. So there is a need to establish an international coordination mechanism for an integrated SSA system that can provide a source and basis for space traffic management (STM) and reliable and accurate situational assessment. The Scientific and Technical Subcommittee (STSC) in UNCOPUOS mentions support for SSA through the 2019 'Long-term Sustainability (LTS) Guidelines for Space Activities', but the‘Legal Subcommittee’ (LSC) in UNCOPUOS needs to propose a Guideline that includes SSA provisions. Whenever space debris is created, responsible States must provide notice and information about the space debris to other countries flying into space. If guidelines on SSA are made in the LSC of UNCOPUOS, soft law obligations will add the necessary stability in this area, and international cooperation of SSA is also a stepping stone for more sophisticated future space activities in STM, of which SSA will be a component.
