인공지능 기본법의 제정과 시행에 대한 고찰

Artificial intelligence (AI) technology is deeply interfering not only with industry but also with the daily lives of citizens, and the government is strengthening its use of AI in administrative tasks. The need for legislation that promotes the development of AI while minimizing its potential negative impact on citizens has been emphasized across various sectors. The enactment of the Framework Act on Artificial Intelligence (FAAI) represents a national and civic commitment to securing cutting-edge AI technology and fostering industrial development and enhanced public convenience through it. However, it is also true that industry, civic groups, and individual citizens, depending on their respective positions, have differing opinions on the practical consequences of the enactment and implementation of the law. The FAAI focuses on development and proposes measures to secure trust. Appropriate feedback through the enactment of the enforcement ordinance and subsequent implementation will help achieve the goals of the law. Although the Framework Act on Artificial Intelligence has been promulgated, there is still time before its implementation. Discussing the content and future challenges of this law before its implementation serves following purposes. First, by revisiting the content of this important law before its implementation, we can prevent potential contradictions or loopholes in its implementation. Second, as AI science and technology are rapidly developing, we can quickly adapt and respond to changing technological and social environments. Third, because the Framework Act on Artificial Intelligence impacts not only the government but also industry and the general public, it can provide an opportunity for relevant organizations and individuals to accurately understand the law's implications and respond accordingly. To achieve these goals, this article first introduces the key provisions of the Framework Act on Artificial Intelligence. Next, we examine which of the previously discussed sections have been enacted and which have been omitted or modified. Next, we explain the key issues contained within the Framework Act on Artificial Intelligence. Finally, we examine the challenges ahead of its implementation. The AI Act's strategy involves promoting technological advancement, responding to the socio-economic changes that accompany AI development, and harmonizing AI development with existing democratic, human rights, and legal systems. This article examines how the Basic Act on AI(FAAI) should be supplemented in the future from the perspective of these three goals.
