성범죄수사에 있어서 장애인피해자의 보호방안

The disability community face many societal barriers including being targets of crime, and such crimes committed against people with disabilities who lack ability to protect themselves are highly likely to be covered up, and there are very few instances where the perpetrator is punished given obtaining statements from victims is challenging. In particular, the disabled are easily lured into dependency through small acts of kindness, which puts them at risk of repetitive and ongoing criminal acts. Moreover, secondary victimization may occur during the course of investigation and evidence collection due to the investigator’s limited investigative techniques. Against this backdrop, this paper explores the criminal investigation and evidence gathering methods of disabled victims based on the specificity of people with disabilities, and also presents the following specific measures for the protection of disabled criminal victims: (i) development of AI contents and enhanced infrastructure support necessary during an investigative process; (ii) foster and nurture specialized personnel and formulation of a unified support mechanism during an investigative process; (iii) activate crime reporting and monitoring in local communities; (iv) establish a system and legal basis for prompt determination of disability status during the initial investigation stage; and (v) develop and provide education on methods for obtaining depositions from people with disabilities.
