의료기사에 대한 지도 권한의 법적 체계와 입법적 개선 방향 -한국․일본 비교법적 고찰을 중심으로-

지도 권한은 현행 법령 및 판례에서 의사의 ‘지도’, ‘구체적 지시’, ‘지도․감독’, ‘의료지도’, ‘구체적인 지휘․감독’ 등의 여러 모습으로 등장한다. 지도 권한은 의료인이 아닌 자가 의료인이 아님에도 불구하고 의료행위를 할 수 있는 법적 근거를 제공하여 의료인이 아닌 자의 의료행위가 무면허 의료행위가 되지 않도록 하는 중요한 기능을 수행하면서 의료인이 아닌 자에게 허용되는 의료행위의 범위까지도 설정한다. 의사의 지도 권한 아래 놓인 여러 직역 가운데, 특히 의료기사는 “의사 또는 치과의사의 지도 아래 진료나 의화학적 검사에 종사하는 사람”이라는 정의로부터 알 수 있듯 지도 권한을 개념의 핵심 표지로 하고 있다. 이러한 이유로 지도 권한의 내용 및 역할과 관련하여 꾸준히 수정 논의가 있어 온 것 중 대표적인 것이 의료기사제도의 개선 및 「의료기사 등에 관한 법률」 개정 문제이다. 본 논문은 이에 주목하여 의료기사제도와 의료기사행위를 중심으로, 현행 법률에서의 의료기사에 대한 지도 권한의 문제점과 더불어 의료기사행위임에도 불구하고 비의료인에 의하여 수행되고 있는 영역에 집중하였다. 일본의 경우 11종의 의료기사를 두고 개별 자격법을 두고 있는데, 의료기사 종별로 지도 권한을 갖는 주체를 명확히 하는 한편 구체적인 업무범위도 지도의 층위를 기준으로 명확히 구분하고 있다. 반면, 6종의 의료기사를 두고 있는 우리나라의 경우 의료행위임이 분명함에도 의료인도 아니고 의료기사 아닌 자에 의해 시행되고 있는 분야가 존재하며 이에는 지도 권한의 확장이 필요하다. 본 논문에서는 의료기사에 대한 지도 권한이 가진 현재의 문제점과 한계를 지적하고, 이러한 문제를 해결하기 위하여 현행 의료기사의 정의규정 수정의 필요성과 그 방향을 제시하고자 하였다. 아울러, 의료기사행위에 준하는 행위임에도 의료행위를 할 수 없는 자에 의해 이루어지고 있는 영역을 찾아 민간자격을 의료기사로 제도화하는 것과 새로운 의료기사를 신설하는 것으로 지도 권한 내로의 편입 방안을 모색하였다.
Abstract
In current legislation and judicial precedents, the concept of medical guidance authority appears under various terms, including a physician’s “guidance,” “specific instructions,” “supervision,” “medical guidance,” and “direct command and control.” It provides the legal basis for non-medical personnel to perform medical acts without thereby constituting the unlicensed practice of medicine, while also defining the scope of such permitted acts. Among the professions subject to a physician’s medical guidance authority, medical technicians are defined as “persons engaged in diagnostic or clinical chemistry examinations under the supervision of a physician or dentist.” Due to this central role, the scope and function of medical guidance authority have been the subject of ongoing legislative debate, particularly regarding reforms to the medical technician framework and the Medical Technicians Act. This paper examines the legal structure and practices governing medical technicians, highlighting deficiencies in the current supervisory framework and the frequent performance of technician‐level medical acts by unlicensed personnel. In Japan, eleven categories of medical technicians are regulated under separate qualification statutes, with the holders of supervisory authority clearly designated and duties classified into levels of supervision—no instruction, specific instruction, or general guidance. By contrast, South Korea regulates six categories under a single statute, yet certain medical acts are still performed by individuals who are neither licensed medical professionals nor medical technicians, underscoring the need to expand and clarify supervisory authority. This study identifies legal and structural shortcomings in South Korea’s supervisory authority over medical technicians, proposes statutory amendments to the definition of medical technicians, and makes policy recommendations for reform. It further advocates incorporating technician‐equivalent activities currently performed by unlicensed personnel into the legal framework, through both the recognition of selected private certifications and the creation of new medical technician categories.
