초록
이 논문은 정년을 앞두신 안강현 교수님의 그간의 업적을 기리며 교수님의 상법과 국제거래법을 아우르는 방대한 연구 업적을 정리하고 이를 후배 연구자들과 공유하는 것을 목표로 한다. 이 논문에서는 안강현 교수님의 상법총칙, 상행위법, 회사법 및 보험해상법 등 상법의 거의 모든 편과 신용장 등 국제거래법 분야에서의 대표적인 저작을 정리해 보았다. 교수님의 학술적 저작들은 공통적으로 연구에 있어 법문과 제도의 본질과 취지에 집중하고, 과도한 유추 또는 확장 해석을 경계하며, 이론적 분석에 그치지 않고 실무에서의 해법을 제시하려는 경향을 보이는 것을 알 수 있다. 이러한 교수님의 실용주의적 경향은 교수님께서 학자의 길을 선택하시기 전 변호사로서 실무에서 쌓으셨던 경험이 영향을 미친 것으로 감히 추론해 본다. 무엇보다 “상(商)”과 법제도의 본질에 대한 탐구에서 문제의 해법을 찾되, 그 해법이 실제 법적 문제에 대한 현실적인 대안이 될 수 있도록 다각도로 탐구하는 교수님의 학문 연구의 방식은 많은 후학들에게 큰 가르침이 될 것이라고 생각한다. 교수님의 학문적 열정과 그간의 노고에 다시금 감사드리며 앞으로도 오랫동안 후학들에게 많은 가르침을 주시기를 바라는 바이다.
Abstract
This paper aims to honor Professor Ganghyeon An’s longstanding achievements as he approaches his retirement by summarizing his extensive academic writings in the areas of Commercial Law and International Trade Law, and to share them with junior researchers. This paper consolidates Professor Ahn’s major writings across almost all sections of Commercial Law, as well as his influential works in the field of International Trade Law. His scholarly writings consistently focus on the fundamental nature and purpose of the specific article and its legal texts, while cautioning against excessive analogy or expansive interpretation. Moreover, they aim not only at theoretical analysis but also at practical solutions, demonstrating a tendency to bridge theory with practice. I dare to infer that this pragmatic approach is influenced by his experiences as a practicing attorney before joining the academia. I believe the characteristics in his research papers, seeking solutions through in-depth exploration of the essence of “commerce” and legal systems, and also ensuring these solutions serve as realistic alternatives to actual legal issues, will serve as a valuable lesson for many junior scholars.
