Vietnam has recently become an important economic partner of Korea through its rapid economic growth. As more Korean companies expand their business into Vietnam, it is necessary to identify the differences between the Occupational Safety and Health (OSH) Act of Vietnam and the Occupational Safety and Health Act of Korea. This study aims to conduct a comparative analysis of the objectives, scope, and penalty provisions of the OSH Acts in both countries. The findings reveal that while Vietnam’s OSH Act applies more broadly than Korea’s, the inclusion of compensation provisions within the same statute may obscure the distinction between accident prevention and liability. In addition, Korea’s legislation provides detailed penalties for violations of preventive measures, whereas Vietnam adopts a more general framework, leaving specific preventive provisions to governmental decrees, thereby emphasizing state-driven accident prevention. This study contributes to a clearer understanding of Vietnam’s OSH Act and provides useful insights for Korean companies operating in Vietnam.
