미국 내 증오범죄의 최신동향과 대책

초록
미국 내 증오범죄의 가장 심각한 부분은 인종주의에 근거한 범죄이고, 흑인, 여성, 성소수자, 노인 등 사회적 약자가 증오범죄의 표적이 되기 쉬움을 알 수 있다. 또한 백인우월주의에 근거한 테러 등 폭력행위의 우려와 반유대, 반무슬림 정서, 그리고 아 시아인 혐오 등에 근거한 증오범죄가 또한 난제가 아닐 수 없다. 최근에는 사회구조 또는 법 제도적 인종차별의 문제가 부각되면서 이에 대한 사회적 논의와 연구가 활발히 전개되고 있다. 특히 형사사법 시스템이 과연 인종 중립적으로 작동이 되고 있는 것인 가에 대한 회의와 비판이 일고 있는 가운데, 판사 또는 배심원의 인종적 편견에 따라 공정한 사법작용을 방해하고 있는 문제가 쟁점이 되고 있다. 우리나라에서도 인종의 다양성이 증가하고 있고, 장애인, 성소수자, 노인 등이 증오 범죄 희생자가 될 수 있다는 점에서 미국에서의 논의와 대책은 매우 유용한 교훈이 되고 있다. 우선 증오범죄에 대한 가중처벌은 범죄 억지 효과가 있을 것이므로 도입의 필요 성이 있다고 본다. 특히 테크널러지를 활용한 인종적 화해를 도모하고자 하는 노력은 우리나라에서도 온라인 상의 의사소통 방법과 인터넷 앱을 활용한 분쟁해결을 도모하는 방안은 적극 검토할 만하다고 생각된다. 무엇보다도 교육현장에서의 인권교육과 평등 의식을 고취할 필요가 있고, 매스미디어 등의 기능과 역할을 최대한 활용하여 사회적 공감대를 형성하는 것이 무엇보다도 중요하다고 할 것이다. 아울러 증오범죄의 낮은 신고율과 사법당국의 소극적 대처 등의 문제점 등이 우리나라에서도 재연되지 않도록 담당 공무원에 대한 직무교육을 강화하고 제도적 미비점을 지속적으로 보완하는 노력이 요구된다.
Abstract
Hate crimes are criminal acts targeting individuals or property, motivated by bias based on race, color, religion, national origin, ethnicity, disability, gender, or sexual orientation. In the United States, racial hate crimes constitute a particularly serious issue, rooted in a long history of white supremacy, anti-Black, antisemitic, anti-Muslim, and anti-Asian sentiment. Women, LGBTQ individuals, and the elderly are also disproportionately vulnerable to such crimes. In recent years, systemic racism and the racial biases of judges and jurors have sparked significant public debate, raising concerns about the fairness and impartiality of the criminal justice system. This study explores the potential deterrent effect of enhanced penalties for hate crimes in South Korea and highlights the role of technology in promoting racial reconciliation. Most importantly, it emphasizes the need for education that fosters respect for human rights and equality, alongside the formation of social consensus through mass media, as essential strategies for preventing hate crimes.
