초록
韓国の人工知能基本法は、 人工知能の健全な発展と信頼基盤の造成に必要な基本的な事項を規定する ことにより、 国民の権益と尊厳性を保護し、 国民の生活の質の向上と国家競争力を強化するのに資する ことを目的とする。 人工知能基本法の制定により、 人工知能事業者に対する規制体系が本格的に樹立･運 営されている。 特に人工知能基本法には、 人工知能の安全性･透明性などに関連する義務および高影響人 工知能に対する規制など、 人工知能事業者に直接的な義務を課す内容が含まれており、 義務違反時に過 怠料処分を受けることになる。 また、 国内代理人指定制度の導入で海外人工知能事業者に対しても厳し い規制が適用されるものと見込まれる。 続いて施行令草案も発表され、 まもなくガイドラインも出る予 定だ。 人工知能基本法を制定し、 関連業界では様々な評価が存在する。 政府レベルの人工知能技術及び産業 振興のための法的根拠が設けられ、 今後の投資が活発に行われるという肯定的な評価があるかとすれ ば、 一部では人工知能基本法上の規制内容が曖昧であるという点で依然として事業環境に不確実性が存 在するという懸念も提起される。 人工知能基本法は、 韓国の人工知能成長の可能性を損なうことなく発展した外国の人工知能技術を基 盤とするデジタル機器およびアルゴリズムから国民の安全を守り、 人権を保護することを優先にしな ければならない。
Abstract
The purpose of the AI Framework Act(Framework Act on the Development of Artificial Intelligence and Establishment of Trust) is to protect human rights and dignity, and to contribute to enhance the quality of life, while strengthening national competitiveness by establishing essential regulations for the sound development of artificial intelligence (ai) and the establishment of trust. With the enactment of the AI Framework Act a regulatory system for artificial intelligence operators is being established and operated in earnest. In particular, the AI Framework Act includes imposing direct obligations on artificial intelligence operators, such as obligations related to the safety and transparency of artificial intelligence and regulations on high-impact artificial intelligence, so violations of obligations will be subject to fines. In addition, with the introduction of the domestic agent designation system, strict regulations are expected to be applied to overseas artificial intelligence operators. Subsequently, a draft enforcement decree will be announced and guidelines will be released soon. There are various evaluations in related industries over the enactment of the AI Framework Act. While there is a positive assessment that investment will be actively made in the future due to the establishment of a legal basis for the promotion of artificial intelligence technology and industry at the government level, some raise concerns that there is still uncertainty in the business environment due to ambiguous regulations under the AI Framework Act. The AI Framework Act should make it a priority to protect the safety of the people and protect human rights from digital devices and algorithms based on foreign artificial intelligence technology that have developed without damaging Korea's artificial intelligence growth potential. Therefore, it is necessary to promote business activities while minimizing industrial damage in legal management, minimizing corporate burden, clarifying intervention requirements for business activities, and activating administrative monitoring and rapid intervention.
