외국인 유학생 관련 법제의 현황 및 과제

본 연구는 한국의 현행 법제가 외국인 유학생의 졸업 후 국내 취업 및 정주를 유인하는 데 얼마나 적합한지를 분석하였다. 이를 위해 먼저 국내 외국인 유학생 관련 법제의 현황을 살펴보고, 유학생의 취업·정주 및 사회통합의 관점에서 해결이 필요한 법제도적 과제를 도출하였다. 분석 과정에서는 외국인 유학생 관련 법제와 헌법재판소 판례, 관련 정책문건, 외국의 법제 및 정책, 그리고 국내외 선행연구를 종합적으로 검토하였다. 분석 결과, 첫째, 우리 헌법은 국민의 권리를 제외한 인간으로서의 권리를 보장하나 이주민을 온전히 품기에는 한계가 있다. 둘째, 유학생이 주요 인적자원임에도 유학생 지원 특례규정이 없어 유학생 유치나 지원에 한계가 있다. 셋째, 대학은 외국인 유학생 지원보다는 효율적 통제ㆍ관리를 위한 규정을 운영하고 있다. 넷째, 지방자치단체 조례는 결혼이주민과 계절노동자 중심으로 규율하고 있으며, 유학생 조례를 시행중인 경우에도 유학생 취업과 정주를 위한 실질적 규정을 갖추지 못하였다. 본 연구는 다음과 같이 유학생 관련 법제의 개선과제를 제안했다. 먼저, 헌법 개정 시 이주민과의 공동 발전의 가치 규정 명문화를 논의하고, 둘째, 이민법과 외국인 유학생 지원법 제정 필요성에 동의하면서도, 제정 이전까지는 현행 법률 개정이 필요함을 밝혔다. 구체적으로 출입국관리법과 외국인처우법에 외국인 유학생 특례규정을 설치하고, 고등교육법에 유학생 취업과 정주 지원 규정을 신설하며, 교육기관정보공개법 개정을 통해 유학생 취업률 정보공시의 근거 마련을 제안했다. 아울러 합헌적 범위에서 유학생의 공직 진출을 보장하기 위한 공무원시험임용령 개정을 주장했다. 대학 학칙에 유학생 지원을 의무적으로 기재하도록 고등교육법 시행령을 개정하고, 유학생의 취업과 정주, 사회통합을 강화하는 방향의 조례 개정을 주장했다. 본 연구는 외국인 유학생 관련 법제 전반의 현황과 문제점을 총체적 관점에서 살펴 관련 연구의 확장에 기여하고, 외국인 유학생이 한국 사회에서 안정적으로 정착하고, 국가 발전에 기여할 수 있는 법제도적 기반을 마련하는 데 기여할 것으로 기대된다.
Abstract
This study examined how appropriate the current legislation in Korea is to attract foreign students to employment and settlement in Korea after graduation. First, the current status of the legislation for foreign students in Korea was examined, and legal and institutional tasks that need to be resolved from the perspective of domestic employment, settlement, and social integration of international students were presented. To this end, we reviewed laws and related policy literature related to foreign students, foreign laws and policies, and previous studies at home and abroad. As a result of the analysis, the international student-related legislation lacked support from international students as migrants, and was defined as a control perspective rather than support, so there was a limit to the employment, settlement, and social integration of international students. The study proposed the following tasks. It proposed discussing the constitutional provisions of the value regulation of joint development with migrants, establishing special provisions for international students in the Immigration Control Act and the Treatment of Foreigners Act, establishing a new regulation for employment support for international students in the Higher Education Act, establishing a basis for disclosing information on the employment rate of international students in the Education Institution Information Disclosure Act, and revising the Civil Service Examination Appointment Decree for international students to enter public office. It also insisted on the revision of university school regulations and ordinances in the direction of employment support for international students and social integration. This study is expected to contribute to the expansion of related research by examining the overall status and problems of the legislation related to foreign students from a holistic perspective, and to establish a legal and institutional foundation for foreign students to settle stably in Korean society and contribute to national development.
