법정소송담당의 유형과 판결의 효력

초록
본 논문에서는 법정소송담당의 분류, 법정소송담당에서의 판결의 효력 확장의 근거, 법정소송담당의 유형과 판결의 효력과의 관계, 기판력의 정당성의 근거와 법정소송담당에서의 기판력의 주관적 범위의 확장에 대하여 살펴보았다. 법정소송담당에서의 기판력의 주관적 범위의 확장과 관련하여서는 직무상의 당사자, 갈음형 법정소송담당 중 파산재단 관련 소송에서의 파산관재인, 회생채무자 재산 관련 소송에서의 관리인, 채권에 대한 압류 및 추심명령을 받은 추심채권자, 유증목적물 관련 소송에서의 유언집행자, 재산상속인의 존부가 분명하지 않을 때 법원이 선임하는 상속재산관리인, 병행형 소송담당 중 채권자대위소송에서의 채권자, 주주대표소송의 주주, 채권질의 질권자로 나누어 피담당자에게 어떤 조건에서 기판력이 확장되는지를 구체적으로 검토하였다. 기판력은 분쟁을 종국적으로 해결하고 법적 안정을 위해서는 그것이 필수적인 제도적 장치라는 점과 절차보장으로써 그 장치가 정당화된다는 점에 정당화 근거를 두고 있다. 법정소송담당에서 기판력의 주관적 확장 범위를 정함에 있어서도 법적안정성과 절차보장이 고려되어야 하고, 특히 절차보장이라는 근거가 강조될 수 밖에 없다. 여기서 절차보장이란 기판력의 주관적 범위의 확장을 받는 자가 반드시 현실적으로 절차에 참여할 것을 의미하는 것이 아니라 참여의 가능성이 주어졌는데 참여하지 않은 경우나 그 절차참여권을 포기하거나 다른 사람에게 넘긴 경우도 포함된다고 봄이 타당하다. 한편 법정소송담당의 기판력의 주관적 범위는 법정소송담당의 유형에 따라 일률적으로 그 범위를 정하는 것은 타당하지 않다. 왜냐하면 법정소송담당은 법률의 규정에 의하여 본래의 권리관계의 주체가 아닌 제3자에게 소송수행권이 주어진 경우로 소송수행권이나 당사자적격과 관련된 것으로 직접적으로 판결의 효력(기판력)과 관련되어 있는 것은 아니기 때문이다. 따라서 법정소송담당의 경우에 기판력의 주관적 범위를 확장할 수 있는지 여부는 기본적으로 기판력의 정당성의 근거(인정근거)에서 찾아야 하고, 정당한지 여부를 판단함에 있어 법정소송담당의 성질과 유형이 중요한 요소로 고려되는 것이 타당하다고 생각된다. 기판력의 주관적 범위를 피담당자에게 확장하는 것이 정당한지 여부를 판단함에 있어 ‘법률상 소송담당자에게 관리처분권이 부여된 결과 담당자가 소송수행권을 가지게 된 경우’의 법정소송담당의 유형 분류와 관련하여 병행형, 갈음형의 구분보다도 담당자와 피담당자의 대립관계 여부, 담당자를 위한 소송담당인지 피담당자를 위한 소송담당인지 여부가 훨씬 중요한 요소가 된다.
Abstract
This paper examines the classification of litigation charges prescribed by law, the basis for the expansion of the effect of judgments in litigation charge prescribed by law, the relationship between the types of litigation charges prescribed by law and the effect of judgments, the basis for the legitimacy of res judicata, and the expansion of the subjective scope of res judicata in litigation charge prescribed by law. Regarding the expansion of the subjective scope of res judicata in litigation charge prescribed by law, author specifically examine the conditions under which res judicata is extended to the following litigation manager prescribed by law: parties acting in their official capacity; bankruptcy trustees in bankruptcy estate litigation and administrators in litigation involving the assets of a rehabilitation debtor, debt collectors who have received orders to seize and collect bonds, executors in litigation involving bequests, estate administrators appointed by the court when the existence of a property heir is unclear amang substitute litigation charge prescribed by law; creditors in creditor subrogation litigation, shareholder in shareholder derivative litigation, and pledgee in bond lien amang parallel litigation charge prescribed by law. The justification for res judicata is based on the fact that it is an essential institutional mechanism for the final resolution of disputes and legal stability, and that its legitimacy stems from its procedural guarantees. When determining the subjective scope of res judicata in litigation charges prescribed by law, legal stability and procedural guarantees must be considered, with procedural guarantees in particular being emphasized. Here, procedural guarantees do not necessarily imply that the person subject to the subjective scope of res judicata will actually participate in the proceedings. It is reasonable to consider that this includes cases where the possibility of participation is given but the person fails to participate, or where the right to participate in the proceedings is waived or transferred to another party. Meanwhile, it is not appropriate to uniformly define the subjective scope of res judicata in litigation charges prescribed by law based on the type of litigation charges prescribed by law. This is because litigation charges prescribed by law are cases where the right to conduct a lawsuit is granted by law to a third party, not the original subject of the legal relationship, and it is related to the right to conduct the lawsuit or to party status, not directly to the effect of the judgment(res judicata). Therefore, in the case of litigation charge prescribed by law, whether the subjective scope of res judicata can be expanded should be fundamentally sought from the basis of the legitimacy (the basis for recognition) of res judicata, and it is reasonable to consider the nature and type of the litigation charges prescribed by law as important factors in determining whether it is legitimate. In determining whether it is legitimate to extend the subjective scope of res judicata to the person in charge, as seen above, in cases where the litigation manager has the right to conduct litigation as a result of the legal grant of management and disposition authority to the litigation manager, it can be seen that the distinction between parallel and replacement types is not as important as whether there is an adversarial relationship between manager and the person in charge, and whether the litigation charge is in charge of the litigation for manager or for the person in charge.
