경제적・사회적・문화적 권리에 관한 국제규약(사회권규약) 선택의정서는 2008년 12월 10일 유엔 제63차 총회에서 채택되었으며, 2013년 5월 5일 발효되었다. 1966년 채택되어 1976년 발효된 사회권규약은 이번 선택의정서를 통해 자유권규약 및 그 선택의정서와 유사한 절차적 수단을 갖추게 되었으며, 이는 국제인권보장 체계 발전에 있어 중요한 전환점으로 평가된다. 사회권규약 선택의정서는 자유권규약과 사회권규약 사이의 오랜 격차를 메우고 국제인권규약 체계의 완결성을 강화하는 중요한 계기가 된다. 현재까지 선택의정서를 비준 또는 가입한 국가는 31개국에 이르지만, 대한민국은 사회권위원회의 지속적인 권고에도 불구하고 비준에 소극적인 태도를 유지하고 있다. 특히 2017년 사회권위원회의 제4차 최종견해에서 한국의 사회권 보장 수준이 최소 기준에 미치지 못하고 8년 전보다 후퇴했음을 보여주는 권고들이 쏟아졌음에도 불구하고, 정부의 개선 의지를 기대하기 어려운 상황이다. 이러한 배경에서 본 논문은 대한민국 정부가 선택의정서를 조속히 비준하도록 설득함으로써 사회권 보장 현실을 개선할 중대한 계기를 마련하는 것을 목적으로 한다. 논문은 우선 선택의정서가 규정한 주요 절차, 특히 개인통보절차의 중요성을 검토하고, 한국 사회에서의 사회권 현실을 진단하여 비준 필요성을 강조한다. 이어 선택의정서 비준 전망과 관련 쟁점 및 쟁점별 대응 전략을 분석하며, 마지막으로 성공적 비준을 위한 전략과 주요 동력, 비준 후 해결해야 할 과제를 제시한다.
Abstract
The Optional Protocol to the International Covenant on Economic, Social and Cultural Rights (ICESCR) was adopted by the United Nations General Assembly on December 10, 2008, and entered into force on May 5, 2013, three months after Portugal became the tenth state party to ratify it. For the first time since its adoption in 1966 and entry into force in 1976, the ICESCR was thereby equipped with procedural mechanisms comparable to those of the International Covenant on Civil and Political Rights (ICCPR) and its Optional Protocol. This marks a watershed moment in the development of the international human rights protection system, enabling the long-delayed realization of the 1948 UN General Assembly’s vision to establish a legally binding covenant encompassing economic, social, and cultural rights. The Optional Protocol functions as a crucial stepping stone in bridging the long-standing gap between the ICCPR and the ICESCR, thereby strengthening the coherence and completeness of the international human rights framework. To date, 31 states have ratified or acceded to the Optional Protocol. Nevertheless, the Republic of Korea continues to demonstrate a passive stance toward ratification, despite repeated recommendations from the Committee on Economic, Social and Cultural Rights (CESCR). The Committee’s fourth concluding observations criticized Korea for failing to meet minimum standards in safeguarding economic, social, and cultural rights and noted regression compared to eight years earlier. The Korean government’s reluctance to engage meaningfully with these recommendations highlights the urgent need for ratification as a critical turning point in advancing social rights protection at the domestic level. This article examines the main procedures introduced by the Optional Protocol, with particular emphasis on the individual communications procedure as a vital enforcement mechanism. It then diagnoses the reality of social rights in Korean society to underscore the necessity of ratification, analyzes the prospects and challenges surrounding ratification, and considers issue-specific strategies to overcome barriers. Finally, it outlines potential approaches and driving forces to facilitate successful ratification and identifies the key tasks that must be addressed in the post-ratification phase.
