방송법 개정안에 나타난 KBS의 법적 독립성 평가: 이사회와 사장의 임면 조항을 중심으로

The institutional framework governing the appointment and dismissal of KBS board members and presidents has proven ineffective in mitigating repeated dismissals following changes in government, thereby functioning as a structural weakness undermining the independence of public service media. While political parties within the legislature have consistently emphasized the elimination of political patronage and the safeguarding of media independence, substantial divergences have been observed in the content and orientation of their legislative initiatives. This study develops a comprehensive analytical framework that conceptualizes the legal independence of KBS’s governance structure—specifically the appointment and dismissal of board members and presidents—across four categories and twelve institutional factors. Applying this framework to legislative proposals introduced since 2000, the analysis reveals that, despite 54 bills being introduced concerning KBS governance, only two were ultimately enacted into law, including the most recent reform in August 2025. A breakdown by party affiliation shows that Democratic Party–affiliated legislators accounted for 37 proposals (68.5%), while People Power Party–affiliated legislators accounted for 9 proposals (16.7%). Substantively, reform proposals concerning the board concentrated on the number of members and the nominating authority, whereas those concerning the president focused primarily on the introduction of presidential nomination committees and the adoption of qualified majority voting—requiring two-thirds approval by the board— for presidential appointments. Nevertheless, the overall index of legal independence derived from these proposals reached a maximum score of only 0.48, indicating that the reforms fell markedly short of ensuring sufficient institutional independence.
