외국인 유학생 지원 조례의 문제점과 개선방향 : 우수 인재의 정주와 사회통합 관점에서
A Study on Problems of the Ordinance on the Support of Foreign Students and the Direction of Improvement : From the perspective of the settlement of talented people and social integration

국내 외국인 유학생은 지난 20여년 사이에 급증하여, 2024년 기준 약 21만 명에 이르렀다. 2020년대 본격적인 인구위기가 시작되며, 이들 유학생은 인구문제를 극복할 지역과 국가의 주요 인적자원으로 주목받고 있다. 본 연구는 외국인 유학생 관련 조례가 제정된 8개 시도의 조례 현황과 문제점을 분석하고, 조례의 개선방향 제시하는 것을 목적으로 한다. 이를 위해, 외국인 유학생 관련 법령과 조례, 중앙정부와 지방정부 정책 문건, 선행연구 등을 종합적으로 분석하였다. 분석 결과, 현행 조례는 유학생 유치 중심의 목표 설정, 미흡한 취업･정주 지원, 성과지표 및 평가체계 부재, 단체장의 과도한 재량권, 권리 보장 및 참여 기반 미비, 지역사회와의 교류 부족 등의 문제점을 지니고 있었다. 이러한 한계로 인해 현행 유학생 조례만으로는 우수 유학생의 국내 취업･정착과 사회통합을 실질적으로 촉진하기는 어렵다. 이에 본 연구는 조례의 목적조항에 취업･정주 및 사회통합 촉진을 명시적으로 규정, 성과지표와 평가 의무 도입, 차별금지 및 상호문화 교류 조항 신설, 유학생 참여 정책 거버넌스 구축 등을 조례 개정방향으로 제시하였다. 본 연구는 외국인 유학생을 단순한 교육정책의 대상이 아니라 지역사회의 구성원이자 인적자원이라는 시각에서 광역 자지체 수준의 조례를 분석하였다. 본 연구는 지역의 인구위기 극복과 지속가능한 성장에 필요한 주요 인적자원인 우수 외국인 유학생의 국내 취업과 정주, 선주민과 이주민의 사회통합을 위한 실천적 과제를 제시함으로써 외국인 유학생이 지역사회의 동등한 구성원으로 자리매김하고 지역사회의 혁신을 이끌 인재로 성장할 수 있는 기반 마련에 기여할 것으로 기대된다.
Abstract
In the midst of changes in the demographic structure due to the low birth rate and aging population, the number of foreign students reached about 210,000 as of 2024, and it is not simply the subject of education policy, but is noted as a future human resource of Korean society. The purpose of this study is to review the current status of ordinances related to foreign students and analyze problems to suggest ways to improve the ordinances for supporting international students. To this end, domestic literature, central and local government policy documents, media reports, and eight metropolitan and local government ordinances enacted to support foreign students were qualitatively analyzed. As a result of the analysis, the current ordinance has problems such as setting attraction-oriented goals, lack of support for settlement and employment, lack of performance indicators, dependence on the discretion of the head of the local government, limitations on guaranteeing the rights of international students, and lack of exchanges with the local community. With the current international student support ordinance, it is expected that it will be difficult for excellent international students to settle in Korea and integrate the society of indigenous people and these migrants. This study suggested ways to revise ordinances such as specifying employment, suspension, and social integration in purpose regulations, introducing performance indicators and evaluation obligations, establishing anti-discrimination and intercultural exchange provisions, and establishing governance for international students' policy participation. This study is meaningful in laying the legal foundation for foreign students to become equal members of the community by presenting tasks for employment, settlement in Korea, and social integration of indigenous people and migrants, which are essential for overcoming the population crisis and sustainable growth in the cross-section of foreign policy-related laws and ordinances and local autonomy-related laws and ordinances.
