국토공간계획 체계 구축을 위한 법제 정비 과제에 관한 연구

Abstract From a spatial perspective, the national land has a multi-layered and pluralistic structure, ranging from the national land space targeting the entire national land to the urban space targeting cities. Therefore, the upper-level national land plan and the lower-level national land plan must have a system that is consistent with each other. However, in the case of metropolitan area plans, provincial comprehensive plans, and city/county comprehensive plans, excluding the national comprehensive plan, there is a structural problem in that it is difficult to expect vertical and horizontal systematicity among these plans, as not only are the planning subjects and planning target scopes different, but the planning goals that the plans seek to pursue are also different. Moreover, in reality, there are numerous special laws related to national land planning, such as the Special Measures Act for the Construction of the New Administrative Capital, the Special Act on the Construction and Support of Innovation Cities Following the Relocation of Public Institutions to Local Areas, the Special Act on Corporate City Development. Therefore, it is difficult to expect systematic national land spatial planning through the basic legal role of the National Land Basic Act. Against this backdrop, this study aims to present a plan to secure the systematic nature of Korea's national land spatial planning, focusing on various types of national land plans according to the National Land Basic Act and urban basic plans based on the Act on National Land Planning and Utilization. To achieve this research objective, the study compares and analyzes the current national land-related planning laws and plans based on these laws from the perspectives of administrative planning and planning systematicity, identifies problems, and suggests legal improvements to address the identified problems.
