국문초록 현대 민주주의 국가에서 선거원은 국민주권의 직접적 실현수단이며 헌법이 보장하는 기본권이다. 선거권은 국민 스스로 정치형성과정에 참여하여 민주주의를 실현하는 수단으로 작용한다. 특히 선거권은 모든 국민에게 평등하게 보장되어야 한다. 하지만 언어·인지적 제약으로 도움이 필요한 발달장애인의 참정권 보장을 위한 제도적 편의는 극히 미흡한 실정이다. 이러한 상황에서 발달장애인이 참정권 보장을 요구한 소송은 실질적 보장이 절실히 요구되는 이유이기도 하다. 이 논문은 서울고등법원의 판결을 중심으로 발달장애인의 참정권 보장에 있어 문제점과 이를 해결하기 위한 법적 방안을 검토하여 대상 판결에서 제시된 의견을 중심으로 발달장애인의 참정권 보장을 위한 방안을 제시하고자 한다. 구체적으로 이 논문은 첫째, 공직선거법 내 ‘발달장애인’을 명시적 용어로 규정하고, 둘째, 그림투표용지·쉬운 글 선거안내서·후보자 시각 정보자료를 공직선거법에 근거 규정으로 명시하고, 셋째, 활동 보조인 및 의사소통 조력인 등을 보조인 자격에 포함하고 역할과 범위를 구체화한 선거관리 규칙을 마련하며, 넷째, 유권자 이해 수준을 고려한 맞춤형 선거자료 제공을 법제화하여, 실효성 있는 정책적 개선방안을 제시한다. 이 논문은 발달장애인을 포함한 모든 국민이 이해가능하고 접근이 가능한 방식으로 선거에 참여할 수 있는 제도를 갖추어 현행 발달장애인 참정권 실현의 한계를 극복하는 데 기여할 것이다. 나아가 헌법상 보통·평등·직접·비밀 선거의 원칙을 실질적으로 구현하는 것이며 궁극적으로는 누구도 배제되지 않는 민주주의를 실현하는 데에도 기여할 것이다.
Abstract
Abstract In a modern democratic country, the electoral district is a direct means of realizing national sovereignty and a basic right guaranteed by the Constitution. The right to vote acts as a means of realizing democracy by participating in the political formation process by the people themselves. In particular, the right to vote should be guaranteed equally to all citizens. However, institutional convenience to guarantee the suffrage of people with developmental disabilities in need of help due to language and cognitive constraints is extremely insufficient. In this situation, a lawsuit that the developmentally disabled person requested to guarantee the suffrage is also the reason why practical guarantees are urgently required. Based on the Seoul High Court's ruling, this paper examines the problems in ensuring the suffrage of people with developmental disabilities and legal measures to solve them, and proposes measures to guarantee the suffrage of people with developmental disabilities, focusing on the opinions presented in the target judgment. Specifically, this paper first defines "people with developmental disabilities" in explicit terms in the Public Official Election Act, secondly specifies picture ballots, easy writing election guides, and candidates' visual information data as regulations based on the Public Official Election Act, thirdly, it includes activity assistants and communication assistants in the qualifications of assistants, prepares election management rules that specify roles and scope, and fourthly, it proposes effective policy improvement measures by legislating the provision of customized election data considering the level of voter understanding. This paper will contribute to overcoming the limitations of realizing the current suffrage of people with developmental disabilities by having a system that allows all citizens, including people with developmental disabilities, to participate in elections in an understandable and accessible way. Furthermore, it will substantially embody the principles of common, equal, direct, and secret elections under the constitution, and ultimately contribute to realizing democracy where no one is excluded.
