전국민 고용보험 로드맵에 대한 평가와 향후 과제 - 노무제공자 고용보험 제도를 중심으로 -

2020년 12월, 정부는 「전국민 고용보험 로드맵」을 발표하면서 특수형태근로종사자, 플랫폼종사자를 거쳐 현재 임의가입 대상인 자영업자까지 고용보험 적용의 폭을 단계적으로 넓히겠다는 계획을 발표하였다. 특히 2020년 예술인, 2021년 노무제공자 고용보험 제도가 시행되었는데, 이들은 각각 월보수액 50만원, 80만원 이상을 가입 요건으로 함으로써 소득기반으로 고용보험 체계의 변화를 시도하였다는 점에서 중요한 의미를 갖는다. 하지만 피보험자격의 취득 및 상실에 있어 여전히 사업(계약)을 단위로 하고, 사업주에게 신고 의무를 부과하는 등 기존 사업장 단위의 틀을 벗어나지 못했다는 한계가 있다. 이에 본 연구에서는 당초 로드맵의 취지대로 고정된 사업장을 넘어서서 인별 관리체계를 구축함으로써 고용보험의 사각지대를 해소할 수 있는 방안을 모색하였다. 그 결과, 본 연구는 다음 여섯 가지 차원의 대안을 제시하였다. 첫째, 근로자, 예술인, 노무제공자 간 피보험자격의 구분을 폐지하고, 월보수라는 단일한 기준으로 제도를 운용 한다. 더 나아가, 현재 임의가입 대상인 자영업자까지 당연가입으로 전환하여 향후 모든 피보험자격의 구분을 폐지하는 것을 목표로 한다. 둘째, 소득 합산에 의한 가입 제한을 폐지하고, 향후 국세청에서 모든 종류의 소득을 합산하여 직권 가입시키도록 한다. 셋째, 일용근로자와 단기예술인, 단기 노무제공자의 고용보험 가입 요건을 일 단위에서 소득 단위로 변경해야 한다. 넷째, 실업급여 수급 요건을 소득 단위로 변경해야 한다. 다섯째, 부분실업급여 제도를 도입해야 한다. 여섯째, 소득기반 고용보험을 추진해 나갈 대통령 직속의 컨트롤타워를 설치하여 정부 각 부처 및 국세청, 근로복지공단 간의 긴밀한 협조를 이끌어낼 필요가 있다. 본 연구는 고용보험 제도에 임금근로 이외의 형태로 계약을 맺고 일하는 다양한 형태의 노무제공자를 포괄하고, 고용보험 체계를 소득 기반의 인별 관리 체계로 전환할 것을 강조했다는 점에서 그 의의가 있다.
Abstract
The Korean government recently announced a series of plans to expand employment insurance, marking a significant step toward the transition from a workplace-based to an income-based insurance model. Coverage is now being extended to self-employed individuals, building on the commitments introduced in 2020 for platform workers and artists. Despite these developments, the system remains constrained within the traditional workplace framework, as it continues to rely on contractual arrangements and employer reporting obligations. This study thus seeks to identify strategies that address blind spots in employment insurance by establishing a management system on a person-to-person basis. six policy alternatives are proposed: abolishing current classification of insured qualifications between workers, artists, and labor providers; integrating income-based enrollment across diverse categories of workers once a real-time income reporting system through the National Tax Service (NTS) becomes operational; redefining requiremnets for employment insurance in terms of income unit rather than daily for daily workers, short-term artists, and short-term labor providers; redefining unemployment benefit eligibility in terms of income loss rather than job loss; a partial unemployment benefit system should be proposed; it is necessary to establish a control tower under the direct control of the President to promote income-based employment insurance system. This research highlights the significance of progressing from a limited wage-based contract model to an inclusive, income-based system that will give more certainty to vulnerable workers.
