아동·청소년 보호 관점에서 인공지능 기반 SNS의 합리적인 규제 방향을 위한 헌법적 연구

The duality of social network service(SNS), stemming from the so-called TikTok ban, has become a source of controversy. While algorithm-based recommendation systems, which everyone has experienced at least once, have the positive effect of enhancing user convenience and efficiency, minors, such as children and adolescents, are not only vulnerable to information but also face new risks due to their high exposure to social media. It is true that children and adolescents are being exposed to sexually explicit and violent content without protection in AI-based SNS environments, and the number of cases experiencing mental health issues is increasing. Though the algorithmic structure of SNS significantly impacts the safety and personal maturation of children and adolescents, who will lead Korea's future, the current legal and institutional regulatory framework continues to be criticized for failing to effectively address these risks. Therefore, this study aims to conduct a constitutional study on the reasonable direction of regulations for the protection of children and adolescents in AI-based SNS environments, balancing the protection of their fundamental rights with the restrictions imposed on them.
