기후난민 보호의 구조와 국제법상 보호

초록
‘기후 변화’는 국경을 넘는 강제이주를 발생시킨다. 소위 기후 난민들이 국제법상 비호신청을 통한 난민등의 지위를 신청할 경우에 대해 종전의 연구들은 보호 가능성을 쉽사리 부정한 경우가 많았다. 그러나 일반적으로 언급되는 법리적 난점에도 불구하고 난민협약상 요건을 기후 난민이 만족시키지 않는다고 단정하기 어렵다. 또한 관련성 요건을 만족하기 어렵다 하더라도 국제인권협약에 따른 보충적 보호지위의 부여는 이론상 난점이 보다 적다. 또한 난민법 레짐 뿐 아니라 기후법 레짐을 함께 고려하면 기후 난민의 경우 피난국의 보호 책임의 법리적 구조가 일반적인 난민의 그것과 다르다는 것을 알 수 있다. 기후 난민의 경우 ‘선진국(주로 부속서 1국가들, 기후 변화 발생 주된 책임)’과 ‘국적국(난민 발생 책임)’, ‘협약국(난민 심사 및 정착 책임)의 3자 구도가 형성되어 재정, 기술, 역량 강화 지원등 선진국의 기후 변화에 따른 난민 보호 책임 분담의 역동이 유엔 기후변화협약과 파리협정의 이행감독 과정에서 발생할 수 있다. 따라서 피난국과 국제사회의 기후난민 보호 책임은 일반적인 경우보다 더욱 강화된다.
Abstract
Climate change causes forced migration across borders. Despite the commonly cited legal difficulties, it is difficult to conclude that climate refugees do not satisfy the requirements of the Refugee Convention. Furthermore, even if the requirement of relevance is difficult to satisfy, granting protection under international human rights conventions presents fewer theoretical obstacles. Moreover, considering refugee law regime and the climate law regime together reveals that the legal structure of the host country's responsibility to protect differs for climate refugees compared to that for conventional refugees. For climate refugees, a tripartite framework emerges involving ‘developed countries (primarily Annex I countries)’, ‘countries of nationality’, and ‘Convention countries’. This dynamic of sharing responsibility for protecting climate refugees, including financial, technical, and capacity-building support from developed countries, may arise during the implementation oversight processes of the UNFCCC and the Paris Agreement. Therefore, the responsibility of host countries and the international community to protect climate refugees is heightened.
