국회입법조사처 및 한국형사법무정책연구원의 현황과 발전방안- 민·상법 입법지원 및 연구기관으로서의 기능을 중심으로 -

This article examines the organization and current status of the work of the National Assembly Research Service, a legislative support agency under the National Assembly, and the Korea Institute of Criminology and Justice, a research institute in the field of civil and commercial law, and suggests development strategies for these organizations. The National Assembly Research Service is responsible for responding to legislative issues and publishing related reports. However, with its current organization, it is difficult to investigate and research the vast amount of legislative data related to civil and commercial law. Therefore, there is a need to establish a system that allows legislative researchers to immediately request investigation or advice on legislative issues that are difficult to investigate or analyze or require specialized research. Currently, there is no government-funded research institute specializing in civil and commercial law, but in 2021, the Korea Institute of Criminology changed its name to the Korea Institute of Criminology and Justice, and began conducting research in the field of civil and commercial law as well. In order for researchers to conduct specialized research in the future, it is necessary to expand the number of specialized researcher and, at the same time, establish research methods in civil and commercial law by referring social science research methodologies such as empirical research. In the long term, it is desirable that a specialized research institute in the fields of civil and commercial law be established and that this institute be equipped with the function of legislative advisement and empirical research as described above.
