전세보증금 반환위험과 피해자 보호 제도 개선 –법률상·사실상 피해자 괴리 해소를 중심으로-

본 연구는 지속되고 있는 전세사기와 보증금 미반환 문제를 중심으로, 현행 대응체계의 구조적 한계를 진단하고 피해자 보호를 위한 제도 개선 방안을 제시하는 것을 목적으로 한다. 「전세사기 피해자 지원 및 주거안정에 관한 특별법」(전세사기특별법)이 제정되었으나, 피해자 인정요건이 지나치게 엄격하여 다수의 임차인이 법적 보호를 받지 못하는 한계가 드러났다. 즉, 법률상 피해자와 사실상 피해자 간의 구조적 괴리가 발생하여 실질적 피해를 입었음에도 구제 대상에서 배제되는 문제가 지속되고 있다. 본 연구는 전세제도의 구조적 취약성과 보증금 반환위험의 유형을 분석하고, 전세사기특별법과 전세보증보험 제도의 운영실태 및 지방정부의 대응 역량을 종합적으로 검토하였다. 이를 통해 피해자 인정 범위 협소, 보증보험의 가입 제한과 사고 처리 지연, 정보 비대칭으로 인한 사전 예방 장치 부재, 중앙·지방정부 간 협력 부족 등이 제도의 핵심적 한계로 확인되었다. 이에 따라 연구는 피해자 정의의 재정립 및 구제기준 완화, 전세보증금 반환보증보험의 의무가입 확대와 지역형 보증체계 구축, 임대차거래 단계에서의 정보공개와 위험경보 시스템 (가칭: Jeonse Risk Alert System, Jeonse Data Hub) 도입, 중앙–지방정부 간 협력 거버넌스 및 통합정보 인프라 제도화 등을 구체적 정책 대안으로 제시하였다.
Abstract
This study addresses the rising risk of non-refundable jeonse deposits caused by fraud and “empty can jeonse.” It critiques the limitations of the current institutional response, particularly the Jeonse Fraud Special Act, which excludes many tenants by setting overly strict victim criteria, thereby widening the gap between legal and de facto victims. Findings reveal major weaknesses, including narrow victim recognition, restrictions and delays in deposit guarantee insurance, insufficient preventive mechanisms, and poor coordination between central and local governments. The study recommends redefining victim categories, expanding mandatory enrollment in guarantee insurance, establishing localized schemes, improving information disclosure and risk alert systems, and strengthening intergovernmental cooperation. It concludes that Korea’s response system must evolve from narrow post hoc measures to a more inclusive and preventive framework to ensure tenant protection and restore confidence in the rental housing market.
