의뢰인 중심적 법률 서비스를 위한 리걸 디자인(Legal Design) 연구

초록
4차 산업혁명 시대에 법률 시장에서 리걸 테크의 활용이 주목을 받으면서, AI 판사와 변호사에 대한 예측까지 생겨났다. 이렇게 기술 발전이 진행되는 상황에서도, 의뢰인과 인간적으로 공감하고 긴밀하게 소통할 수 있는 변호사가 지닌 전문성은 여전히 유효하다. 그러나 이전과 달리, 오늘날 의뢰인들과 업계에서는 법률 서비스에 대한 니즈가 점점 커지고 세분화되고 있는 상황이다. 그에 따라 변호사와 로펌은 기존의 법률 서비스를 새롭게 혁신할 것을 요구받고 있다. 이에 따라 부상하고 있는 리걸 디자인(Legal Design)은 아직까지 우리나라에서 활발히 논의가 시작되지 않은 분야이다. 그러나 오늘날 법률 서비스의 근본적인 혁신을 위해서는 디자인 씽킹의 핵심인 인간중심적 접근을 적용하여 가능성을 적극적으로 모색해야 할 것이다. 본 연구는 리걸 디자인 및 리걸 테크와 관련된 최근 연구와 자료들을 바탕으로 리걸 디자인의 개념을 파악하고, 오늘날 의뢰인들이 법률 서비스에 대해 갖는 인식과 경험을 고찰함으로써 의뢰인 중심적 리걸 디자인의 필요성을 주장한다. 더불어 로펌에서 적용 가능한 리걸 디자인 프로세스 모델을 살펴봄으로써, 이를 통해 기존 법률 서비스의 문제점들을 해결하고 잠재적인 고객 수요를 확장할 수 있을 것으로 기대한다.
Abstract
In the era of the Fourth Industrial Revolution, the use of legal tech in the legal market drew attention, leading to predictions about AI judges and lawyers. Even in this technological development, the expertise of lawyers who can humanly sympathize and communicate closely with clients is still valid. However, unlike before, the need for legal services is growing and segmented in clients and the industry today. Consequently, lawyers and law firms are being asked to innovate their existing legal services. Legal design, which is emerging as a result, has yet to be lively discussed in South Korea. However, for fundamental innovation in legal services today, it is necessary to actively explore the possibilities by applying a humancentered approach that is at the heart of design thinking. This study argues for the need for client-centered legal design by identifying the concept of legal design based on recent research and materials related to legal design and legal tech and examining the perceptions and experiences clients have with legal services today. Furthermore, this study seeks the applicable legal design process model of lawyers, which is expected to address the problem of prospect demand existing legal services.
