애국가에 관한 저작권법의 諸 문제의 검토

초록
본고는 애국가와 관련하여 ｢저작권법｣과 결부되어 있는 ⅰ) 애국가 저작물성 및 그에 따른 창작자 확정 문제, ⅱ) 애국가 악곡의 외국 민요와의 유사성 문제, ⅲ) 애국가 기증에 관한 문제, ⅳ) 새로운 국가 제정에 관한 문제를 검토하였다. 본 검토를 통하여 악곡과 가사가 결합되어 있는 저작물은 각각 어문저작물과 음악저작물이 상호 결합되어 있는 결합저작물로 보는 것이 타당하며, 이를 애국가의 창작자의 확정에 적용하여 안익태가 애국가의 악곡에 관한 저작자임을 확인하였다. 또한, 안익태가 작곡한 애국가의 악곡과 불가리아 민요의 가락을 중심으로 여타 음악 구성요소를 종합적으로 비교한 결과, 실질적인 유사성에 관한 판단은 향후 관련 전문가 간의 추가적인 검토가 필요함을 확인하였다. 한편 ｢저작권법｣의 기증 제도는 ｢국유재산법｣의 기부채납 제도와 유사함을 확인하였다. 현행 ｢저작권법｣에 규정되어 있는 기증 제도의 취지는 그대로 유지할 필요가 있으나 ｢국유재산법｣의 기부채납의 구조에서 그 형식과 내용을 참고하여 전면적으로 재정비하여야 함을 확인하였다. 끝으로 국가(國家)가 새로운 국가(國歌)를 제정하는 경우, 국가의 창작자의 지위에 따라 저작자가 달라질 수 있으므로 국가(國家)가 창작자를 고용하여 국가(國歌)를 완성한 후 공표를 통하여 國家의 업무상 저작물로 하는 방식이 바람직하다는 결론을 도출하였다.
Abstract
This study examined four issues concerning the Korean National Anthem under Copyright Act: i) the issue of the work’s originality and the identification of the creator, ii) the issue of similarity between the national anthem’s melody and foreign folk songs, iii) the issue of donating the copyright, and iv) the issue of establishing a new national anthem. The review confirmed that works combining melody and lyrics should appropriately be viewed as combined works of musical works and literary works. Applying this to the identification of the creator of the National Anthem, it was confirmed that Ahn Eak-tai is the author of the national anthem's music. Furthermore, the comprehensive comparison of the melody composed by Ahn Eak-tai with Bulgarian folk songs indicates that the judgment regarding substantial similarity requires further review among relevant experts. It was also confirmed that the copyright donation system under the Copyright Act is similar to the “Contributed Acceptance” system under the State Property Act. While the legislative intent behind the current donation system in the Copyright Act should be maintained, the system requires overall reorganization by referencing the structure, form, and content of the State Property Act's Contributed Acceptance system. Finally, regarding the state establishing a new national anthem, the author may vary depending on the creator's status. Therefore, it is desirable for the state to hire a creator to complete the national anthem, and then designate it as a work made for hire for the state through public announcement under Copyright Act Article 9.
