대학 교양교육을 통한 지식재산권 침해 범죄예방 모델 연구

디지털 창작ㆍ학습 환경의 확대로 지식재산권 침해는 대학생의 일상적 활동 속에서 빈번하게 발생하는 구조적 문제로 자리 잡고 있다. 그러나 국내 대학의 지식재산 교육은 여전히 법률 중심의 단편적 전달에 머물러, 실제 창작 맥락에서 요구되는 판단 능력과 예방 역량을 강화하기에는 한계가 있다는 지적이 제기되고 있다. 이에 이 연구는 대학 교양교육을 기반으로 지식재산권 침해를 예방할 수 있는 교육모델을 체계적으로 구성하는 것을 목적으로 한다. 국내외 문헌, 정책자료, 해외 대학 사례 분석 결과, 국내 대학생의 저작권 인식과 실천 수준은 낮은 편이며 침해행위는 무지ㆍ관행ㆍ불명확한 규범 인식 속에서 반복되는 경향이 확인되었다. 반면 해외 대학은 지식재산 교육을 디지털 시민성, 윤리적 판단, 문제해결 능력을 강화하는 핵심 교육으로 운영하고 있으며, 사례 기반 학습과 프로젝트 기반 학습 등 실천 중심 교수전략을 적극 활용하고 있었다. 이러한 비교 분석은 국내 교육이 단순 규범 설명을 넘어 행동 변화를 유도하는 예방 중심 교육으로 전환될 필요성을 시사한다. 이 연구는 가치ㆍ태도 변화 이론, 사회학습이론, 예방교육(PVE) 관점을 적용하여 창작자 권리 존중의 내면화, 공정 이용 판단 역량, 합법적 활용 능력, 문제해결 중심 학습 구조를 포함하는 교육모델을 제시하였다. 지식재산권 침해가 처벌 중심 대응만으로는 감소되기 어렵고, 학습자의 가치ㆍ태도ㆍ행동을 변화시키는 교육적 개입이 필요하다는 점을 강조한다. 학문적으로 이 연구는 국내 대학에서 지식재산권 침해 예방을 핵심 목표로 한 교육모델을 체계적으로 제안한 점에서 의의를 가지며, 정책적으로는 교양교육 기반의 지식재산 교육 확대, 대학–정책기관–산업계 연계 강화, AIㆍSNS 기반 신유형 침해 대응 교육의 필요성을 제언한다. 다만 문헌 중심 분석이라는 한계가 있으며, 향후 실험ㆍ적용 연구를 통해 모델의 효과성을 검증할 필요가 있다.
Abstract
The rapid expansion of the digital knowledge ecosystem has intensified intellectual property(IP) infringement among university students, transforming it from an isolated legal violation into a pervasive socio-educational challenge. Although students actively participate in digital creation and content use, their awareness of copyright norms and their compliance in practice remain limited. Existing university-level IP education in Korea largely focuses on legal and technical information, offering insufficient support for developing practical judgment and preventive competencies. This study proposes a preventive and value-oriented instructional model within general education to address these gaps by fostering digital citizenship, ethical decision-making, and lawful content-use behaviors. Through a comprehensive review of domestic and international research, institutional reports, and university-level instructional cases, the study identifies structural limitations in Korea’s current IP education and contrasts them with more integrated, practice-based approaches implemented in the United States, Japan, and Europe. Drawing upon the value–attitude change framework, social learning theory, and preventive education perspectives, the study develops a conceptual model emphasizing value internalization, practice-based learning, and decision-making competence. This model presents academic and policy implications for restructuring general education curricula to address IP infringement as a preventable behavior, while offering directions for institutional support and future empirical validation.
