초록
정당방위는 ‘현재의 부당한 침해’를 요건으로 한다. 이를 판단할 때, 가해자의 행위가 구성요건에 해당하고 현재의 행위인지 여부를 기준으로 하기보다, 피해자의 입장에서 피해자가 현재의 침해에 대응하는 행위로 방어행위를 하였는지, 규범적으로 이에 대한 허용이 가능할 것인지가 기준이 되어야 한다. 대상판결은 정당방위에 있어 ‘일련의 연속되는 행위로 인해 침해상황이 중단 되지 아니하거나 일시 중단되더라도 추가 침해가 곧바로 발생할 객관적인 사유가 있는 경우’는 침해의 현재성을 인정하여, 구체적인 상황에 따라 현재성 범위를 다소 넓히는 태도를 취하였다. 대상판결이 명시적으로 밝히지는 않았으나, 이는 ‘현재의 부당한 침해’ 여부를 판단함에 있어 규범적 측면을 충분히 고려한 취지로 이해된다. 피해자의 방어행위가 적법한지 여부를 따지기 위해 방어행위 이전, 이후의 상황을 모두 고려하여 규범적, 종합적 판단을 한 결과라 하겠다. 대상판결의 논지는 앞으로 상습적인 가정폭력 등 가해행위가 반복되는 계속 적 침해 상황, 피해자에 대한 심리적 지배 및 조종을 전제로 하는 가스라이팅 범죄 상황, 스토킹 범죄의 경우에 있어서도 정당방위 인정 가능성을 확장하는 이론적 근거가 될 수 있을 것이다.
Abstract
Self-defence requires the existence of an “unjustified current infringement”. In making this determination, the focus should not be on whether the perpetrator's actions meet the elements of a crime or whether they constitute a present act. Whether the victim engaged in defensive conduct in response to the current infringement, and whether this can be normatively permitted, should serve as the standard. The subject judgment recognised self-defence against the current infringement where “infringement arising from a series of consecutive acts is not halted, or even if temporarily halted, there are objective grounds for further infringement to occur immediately”. Although the subject judgment did not explicitly state this, it is understood to have been intended to give due consideration to the normative aspect when determining whether an “unjustified infringement currently exists”. The subject judgment assessed whether the victim's defensive actions were lawful by considering both the circumstances before and after the defensive actions, applying a normative and comprehensive standard. The reasoning of the subject judgment may serve as a theoretical basis for recognising self-defence more broadly in the following circumstances. Situations of persistent abuse involving repeated perpetrator actions such as habitual domestic violence; situations of gaslighting crimes premised on psychological domination and manipulation of the victim; situations of stalking crimes.
