기후위기 대응과 기후대응기금의 제도적 개선방안

2025년 11월 26일 국가인권위원회가 발표한 국가인권통계분석에 의하면 기후위기가 심각한 문제라고 답한 인원은 10명 중 8명(86.5%)에 달하는 것으로 집계되었다.“국민 10명 중 6명 기후위기는 인권문제라 인식”, 「뉴시스」, 2025년 11월 25일자.https://www.newsis.com/view/NISX20251125_0003415674 (최종방문일 2025. 12. 25.). 이화여자대학교 법학논집 제30권 제2호 통권 92호 (2025. 12) Ewha Law Journal, vol.30, no.2 (2025. 12) 최근 정부는 2035 국가온실가스 감축목표를 2018년 대비 53~61% 감축하는 내용으로 확정하였는데 이로써 기후위기 대응을 위한 탄소중립 추진은 더욱 가속화 될 것이며 이제 탄소감축은 더 이상 환경의 문제가 아닌 산업경쟁력이자 국가경쟁력의 문제라고 할 수 있다. 이를 위한 기술개발, 산업전환, 사회적 안전장치 마련 등에는 막대한 재정투자가 수반되며 이러한 전환의 중심에 기후위기 대응을 위한 공공재원으로서 기후대응기금이 있다. 이에 본 고에서는 기후대응기금의 법적 근거(II)와 기후대응기금의 운용 현황 및 ‘25년 존치평가의 내용(III)을 먼저 검토한 후 기후대응기금의 제도적 개선방안(IV)을 제안하였다. 주요 개선방안으로 첫째, 기후대응기금의 수입원 확대를 위한 배출권의 유상할당 확대, 교통ㆍ에너지ㆍ환경세의 전입금 확대, 교통ㆍ에너지ㆍ환경세의 탄력세율 조정 완화, 수송부문에서의 탄소세 도입 고려에 대한 것으로 각 내용에 대해 살피며, 둘째, 기금사업의 목적 및 역할의 명확화를 위한 방안 및 셋째, 성과평가 및 성과관리와 아울러 최근 탄소중립기본법의 개정내용을 반영한 관리방안을 검토하였다. 마지막으로 지자체 기후대응기금과의 협력적 관계 구축에 대한 내용을 제안하여 보다 효율적인 운용방안을 모색하고자 하였다.
Abstract
According to the National Human Rights Statistics Analysis released by the National Human Rights Commission of Korea on November 26, 2025, more than eight out of ten people (86.5%) responded that the climate crisis is a serious issue. Recently, the Korean government finalized the 2035 Nationally Determined Contribution (NDC), aiming for a 53% to 61% reduction in greenhouse gas emissions compared to 2018 levels. This policy shift is expected to further accelerate the transition toward carbon neutrality, transforming carbon reduction from a mere environmental concern into a critical factor for industrial and national competitiveness. Achieving these goals requires massive financial investment for technological development, industrial transition, and the establishment of social safety nets. At the center of this transition lies the Climate Response Fund, serving as a vital public financial resource for climate action. This paper first examines the legal basis of the Climate Response Fund (II) and its operational status, including the findings of the 2025 Fund Sustainability Evaluation (III). Subsequently, it proposes institutional improvement measures for the Fund (IV). As for the primary improvement measures, the paper first explores ways to expand the Fund’s revenue sources, specifically by increasing the auctioning of emission allowances, expanding transfers from the Transport-Energy-Environment Tax, easing the adjustment of flexible tax rates, and considering the introduction of a carbon tax in the transport sector. Second, it suggests measures to clarify the objectives and roles of fund-supported projects. Third, it reviews management strategies for performance evaluation and monitoring while reflecting recent amendments to the Framework Act on Carbon Neutrality. Finally, this study seeks to identify more efficient operational methods by proposing the establishment of a cooperative relationship with local government climate response funds.
