초록
최근 국내외 학계에서 구조적 부정의(structural injustice)에 관한 논의가 활발하게 이루어지고 있다. 여러 쟁점을 관통하는 하나의 화두로, 구조적 부정의의 발생과 대응에 있어서 법이 어떤 역할을 하는지 혹은 할 수 있는지의 문제가 있다. 구조적 부정의론의 주요 사상가인 아이리스 매리언 영(Iris Marion Young)은 법의 역할에 회의적인 견해를 곳곳에서 밝히고, 이에 따라 법이 구조적 부정의의 형성과 이해, 그리고 대응과 극복에 크게 역할을 하지 못한다는 법 무용론을 견지한 것으로 해석되고는 한다. 이러한 해석에도 불구하고, 2차 문헌 연구에서는 법제를 중심으로 한 구조적 부정의 사례 분석, 법제 개혁을 활용한 구조적 부정의 극복안들이 제기되고 있고, 최근에는 구조적 부정의의 이해와 대응에 있어서 법이 흔히 생각되는 것보다 중요한 역할을 할 수 있다는 적극적인 논변들도 제기되고 있다. 본 논문은 영의 주요 저작인 Responsibility for Justice와 유관 2차문헌의 비교 검토를 통해서 구조적 부정의와 법의 관계를 좀 더 정확하게 파악하여 후속 연구에 기여하고자 한다. 영이 구조적 부정의의 특성과 그에 적합한 책임 부여 방식을 어떻게 이론화하는지 검토함으로써, 영은 법의 역할에 대해 일부 해석이 제기하는 전면적 무용론이 아닌, 구조적 부정의의 분석과 대응에 있어서 법적 경로에만 의존하는 것의 부작용을 경고하는 일종의 경계론을 견지한다고 논증한다. 이러한 경계론에 따르면, 구조적 부정의의 대응은 법과 법 외 영역의 변화와 행동을 공히 추구하는 다면적 접근을 필요로 한다.
Abstract
This article examines the relation between structural injustice and law, as theorized by Iris Marion Young in her influential work on structural injustice and discussed in recent literature. Against readings on which Young held a comprehensive irrelevance thesis about the law’s role in both the presence of and responses to structural injustice, this article argues that Young’s critical remarks about law and “the liability model”—understood as the paradigm of legal reasoning—are more constructively read as cautioning against exhaustively legal approaches to structural injustice, e.g., approaches that see the establishment of legal liability as a sufficient response. The article examines, in turn, views affirming the role of law via examples of legal doctrines that depart in some way from the liability model and views appealing to general legal theoretical views on the fundamental role of law in determining persons’ rights and freedoms. While both kinds of view might be framed as objections to Young’s discussion of the relation between law and structural injustice, this article argues that they are better understood as offering useful alternative points of emphasis that are compatible with Young’s view.
