통일헌법의 기본원리와 통치구조의 기본제도 -권력 통제의 메카니즘이 작동하는 통일국가를 그린다-

The blueprint for a new country that will overcome division and make it a peaceful absorption and unification should be to change "The Republic of Korea is a democratic republic" in Article 1, Paragraph 1 of the current Constitution to "The Republic of Korea is a democratic federal republic". In other words, it should be a social rule of law in which a mechanism of power control based on democracy, federalism, and republicanism operates. In order to realize a democratic state, a federal state, a republican state, a rule of law, and a social state in the unified constitution, democracy, federalism, and republicanism should be adopted as basic principles, and a federal system, a dual government system, a bicameral system, a multi-party system, a career civil service system, a local autonomy system, and a constitutional court system should be designed. Above all, a unified state in which the mechanism of vertical power control by the people operates can be realized through direct and indirect participation of the people, elections, freedom of press, and freedom of party activities. The subject of the unification constitution should be the people. If you look at Korean history, the government did not do all the important work. The people did. The historical events that made great changes in Korean history were accomplished by the people, not the government. After analyzing the normative structure of the provisions related to unification of the current constitution, the process of enacting the unification constitution is organized, and the power structure of the unification constitution in which the basic principles of the unification constitution are realized is sought.
