부동산감독원의 헌법적 의미와 입법방안에 관한 고찰

초록
전세사기･시세조작･자전거래･집값띄우기･불법중개･내부정보이용･재건축재개발비리･기획부동산･불법증여자금거래･불법전매･청약통장거래 등의 부동산범죄가 끊임없이 발생하고 있다. 중대한 각종 부동산범죄로 인해 부동산시장질서 교란, 국민 주거안정 침해, 부동산소비자권리 침탈 등의 문제들이 지속되면서 개인의 기본적인 인권과 헌법상 기본제도인 가족제도 그리고 사회 및 국가의 현실과 발전뿐만 아니라 미래까지도 악영향과 부정적인 파급효과가 미치고 있다. 따라서 부동산 분야에서도 금융 분야에서 금융범죄를 대응하기 위한 금융감독원을 설립한 것과 마찬가지로 부동산감독원이 설립･운영됨으로써 지금까지 노정되었던 부동산범죄를 근절하여 국민의 삶과 기본적 인권･사회의 질서와 안정망 그리고 국가의 발전과 미래를 지속가능하게 보장해야 할 필요성이 증대되었다. 이 연구에서 지능화･조직화･첨단화된 각종 부동산범죄가 국민과 국가에 악영향을 미치는 상황에 대한 적절한 대응을 위하여 부동산감독원의 의의와 입법방안 필요성, 헌법적 의미와 시사점, 관련실태와 문제점을 분석하고, 부동산감독원의 입법방안의 방향과 세부내용을 검토한다. 이를 통하여 부동산범죄를 관리･감독하는 부동산감독원이 지속가능하게 설립･운영될 수 있도록 기여하고자 한다.
Abstract
Real estate crimes such as lease fraud, market manipulation, wheel-trading, price inflation, illegal brokerage, insider trading, corruption in reconstruction and redevelopment, planned real estate, and illegal gift fund transactions continue to persist. These various real estate crimes are undermining public housing stability, disrupting real estate market order, and violating real estate consumer rights, negatively impacting the present and future of individuals, society, and the nation. Therefore, the establishment and operation of the Real Estate Supervisory Service has heightened the need to eradicate existing real estate crimes and ensure the sustainable protection of people's lives, basic human rights, social order, and safety nets, as well as the nation's development and future. This study analyzes the significance of the Real Estate Supervisory Service, the necessity of legislative measures, the constitutional significance and implications, and the current state of affairs and challenges facing the nation and the public as a result of increasingly sophisticated, organized, and sophisticated real estate crimes.
