인월 이흥재 교수의 ‘풍토적’ 사회보장법학 - 역사, 현장, 사람

이흥재 교수는 법학을 함에 있어서 법 문언을 넘어서 법이 형성된 풍토까지 연구를 하였다. 이에 이흥재 교수의 법학을 일응 ‘풍토적 사회보장법학’이라고 명명할 수 있겠다. 이흥재 교수는 1990년부터 관련 연구를 시작하여 2011년에 “사회보장법 형성의 풍토적 특징”에 이르기까지 사회보장법 형성의 역사를 연구하였다. 이를 통해 이흥재 교수는 “보장의 필요성과 보장의 정도가 반비례하는 소득역진적인 2중의 불평등 보장구조”라는 사회보장법 현실을 구조적으로 진단하였다. 이와 같이 이흥재 교수는 언제나 사회보장법의 “실효성”을 중요한 연구과제로 삼아 왔고 이를 위해 형식적인 법문언보다는 “현장”을 강조하였다. 이에 학부에서는 사회보장수급자 인터뷰를 진행해 왔으며, 대학원에서는 판례연구를 진행해 왔다. 또한 입법사 연구를 할 때에도 국회속기록, 신문기사, 관계자의 증언 등 1차적 사료를 근거로 과거의 “현장”을 재현할 것을 요구하였다. 이흥재 교수는 “현장”에 대한 연구 과정에서 많은 “사람”들을 만날 수 있었다. 이흥재 교수는 노동법 제정사 연구 과정에서 전진한을 만났듯이, 사회보장법 입법사 연구의 과정에서도 사회보장심의회 위원들을 만났다. 이와 같이 이흥재 교수의 연구에는 언제나 사람이 중심에 있었다. 이흥재 교수는 평생 인간다운 생활을 할 권리에 대해서 탐구해 왔으며, 인간다움의 핵심을 금강경의 무주상보시에서 찾았다. 이를 바탕으로 소태산, 우촌, 백봉의 현장헌신생활을 인간다운 생활의 진정한 표본으로 제시하였다. 이와 같은 이흥재 교수의 학문적 성과는 후학들에게 이정표가 될 것이고, 향후 대한민국의 사회보장법의 형성을 이끌어 갈 연구자들에 대한 묵묵한 격려가 될 것이라고 생각한다.
Abstract
Professor Lee, Heung Jae, in his legal studies, goes beyond the letter of the law to examine the culture in which it was formed. Therefore, his legal studies can be broadly called “cultural and historical studies on social security law.” He researched the history of social security law from 1990 to 2011. Through this studies, he structurally diagnosed the reality of social security law as a “dual, income-regressive, unequal security structure where the need for security and the level of security are inversely proportional.” He consistently stressed the “effectiveness” of social security laws, emphasizing the “real world” rather than the formal language of the law. Accordingly, he made his students conduct interviews with social security beneficiaries, and study case law. Furthermore, when researching legislative history, he has insisted on recreating the past, drawing on primary sources such as National Assembly records, newspaper articles, and testimonies from relevant parties. He met many “persons” during his research on the history. For example, just as he met Jeon Jin-han during his research on the history of labor law, he also met some experts during his research on the legislative history of social security law. Figures have always been central to Professor Lee's research. He has devoted his life to exploring the right to a life worthy of human dignity, finding the essence of humanity in the Diamond Sutra's principle of non-existence. Building on this, he presented the dedicated lives of Sotaesan, Uchon, and Baekbong as models of a human dignity. His academic achievements will serve as a milestone for future generations and a silent encouragement to researchers who will lead the development of South Korea's social security laws.
