다크웹 마켓플레이스의 발전 양상과 AI를 활용한 다크웹 기반 범죄의 수사상 쟁점

With the introduction of AI into investigative procedures, it's only natural that AI will be utilized in dark web-based investigations, where traditional methods have struggled with limitations. As the traditional anonymity of dark web-based crimes is gradually being overcome, AI is now particularly effective in understanding the extensive evidence and complex flow of virtual assets. While early forms of AI have been used in dark web-based crime investigations overseas since before the 2020s, they have achieved some success. However, dark web marketplaces are also experiencing a seesaw game, with investigative agencies responding in a self-evolving manner. This study aims to analyze the current role of AI in dark web-based crime investigations and the impact it will have on our criminal procedure system as AI advances. To this end, we will first briefly examine the dark web and dark web marketplaces. Beyond a general understanding of the dark web, we will examine how dark web marketplaces have evolved in response to existing investigations and draw implications for criminal policy. This study will examine the rise of AI in dark web-based crime investigations. Next, we will select three representative overseas cases of AI utilization in dark web-based crime investigations. We will examine the facts, how AI has been utilized in these investigations, and evaluate these cases. Finally, we will examine the policy implications of these existing investigations. This section analyzes three key criminal policy implications derived from these cases, including the admissibility of using AI to summarize and visualize the vast amounts of data uncovered during dark web investigations.
