AI 시대, 국내 창업지원 법·제도의 한계와 재설계 : 혁신 저해 요인 분석 및 규제 불확실성 해소를 중심으로

본 연구는 인공지능(AI) 시대의 창업 환경이 데이터에 대한 극단적 의존성, 막대한 초기 자본 수요, 그리고 복잡한 윤리적·법적 책임이라는 고유한 특성을 지니고 있음을 진단한다. 이러한 환경 변화에도 불구하고, 국내 현행 창업지원법제인 「중소기업창업 지원법」 및 「벤처기업육성에 관한 특별법」은 전통적인 제조업 패러다임에 머물러 있으며, AI 스타트업의 핵심 필요를 충족시키지 못하고 있다. 더욱 심각한 문제는 AI 혁신을 지원하기 위해 도입된 보완적 법제들 역시 근본적인 한계를 노출하고 있다는 점이다. 이런 한계가 '규제 불확실성'을 증폭시킴으로써, AI 스타트업에 대한대규모 장기 투자를 근본적으로 저해하는 핵심 요인임을 논증한다. 본 연구는 미국 및 유럽연합(EU)의 상이한 법제접근법을 비교 분석한다. 이를 바탕으로 현행 규제 샌드박스의 전면적 개편, AI 윤리 비용의 R&D 세액 공제 인정, 'AI 기본법' 내 스타트업 차등 규제(safe harbor) 도입을 핵심적인 법제도 개선 방향으로 제안한다.
Abstract
This study diagnoses that the startup environment in the Artificial Intelligence (AI) era possesses unique characteristics, such as extreme dependency on data, demand for massive initial capital, and complex ethical and legal liabilities. Despite these environmental shifts, Korea's current startup support statutes?specifically the Support for Small and Medium Enterprise Establishment Act and the Act on Special Measures for the Promotion of Venture Businesses?remain tethered to a traditional manufacturing paradigm, failing to meet the essential needs of AI startups. A more critical issue is that supplementary legislations introduced to support AI innovation also expose fundamental limitations. This study argues that these limitations amplify "regulatory uncertainty," thereby serving as a key factor that fundamentally deters large-scale, long-term investment in AI startups. This paper comparatively analyzes the divergent legal approaches of the United States and the European Union (EU). Based on this analysis, the study proposes the comprehensive overhaul of the current regulatory sandbox, the recognition of AI ethical compliance costs as R&D expenditures for tax deduction, and the introduction of differential regulations (safe harbor) for startups within the AI Basic Act as key directions for legal institutional reform.
