철도시설 사용허가에 관한 공법적 연구

초록
2003년 철도산업 구조개혁 이후 약 22년이 경과하면서 형성된 복잡한 철도법제의 특성으로 인해, 동일한 철도시설을 대상으로 사용허가와 점용허가 방식이 혼재되어 있어, 그 이해와 법적 체계의 명확성이떨어지고 변화하는 미래철도산업 환경에 부합되지 않는 법적 구조라는 비판이 제기되고 있다. 일부 입법론에서는 양 허가체계의 복잡성에 따라 양자를 점･사용허가로 동시에 표기할 것을 제안하기도 하지만, 실제로 이처럼 병기표기한 법률들 역시 각각의 요건에 맞추어 구분할 필요가 있는 경우 개별 조문을 통해 분조화 해서 구분하고 있는바, 각 허가의 요건을 보다 명확하게 체계화 하지 않는 한 ‘점･사용허가’라는 법률용어의 법제화 자체가 오히려 철도법제의 체계성을 저해시키는 요인이 될 수 있을 것이다. 철도시설 사용허가 및 점용허가제도는 본질적으로는 유사하지만 철도사업 활용을 위한 각각의 목적에 따라 각각 분화및 발전된 자산활용방식이란 점에서 그 고유성을 인정해야만 하며, 해당 제도의 법적 요건과 체계를 보다명확히 함으로써 그 법적 체계가 보다 명확해질 수 있다고 판단된다. 따라서 본 연구에서는 그 중심이 되는 철도법제상 사용허가 규정을 고찰하여 법적 체계의 명확성을 저해하는 요인을 발굴하고 그에 대한 개선방안을 제시하고자 하였다.
Abstract
The complex nature of railway legislation, developed over the past two decades since the restructuring of the railway industry, has led to a mix of use and occupancy permits for the same railway facilities. This has led to criticism that the legal structure lacks clarity and adapts to the evolving future of the railway industry. Some legislative theories suggest simultaneously labeling both permits as "occupancy/use permits" due to their complexity. However, in practice, even laws that distinguish between these two types of permits often differentiate them through separate provisions when necessary. Unless the requirements for each permit are clearly systematized, the very codification of the term "occupancy/use permit" could undermine the systematic nature of railway legislation. While railway facility use and occupancy permit systems are fundamentally similar, they represent distinct and developed asset utilization methods tailored to the specific purposes of railway operations. Furthermore, clarification of the legal requirements and structures of these systems will undoubtedly enhance the clarity of the legal framework. Therefore, this study examined the central railway law's use permit provisions, identifying factors hindering the clarity of the legal system and proposing improvement measures.
