제23회 한중형법국제학술대회를 통해 바라본 중국 형법학의 발전과 비교법연구의 필요성 - 생태환경보호 법제의 변화를 중심으로 -

초록
제23회 한중형법국제학술대회는 개별 발표의 내용이나 특정 쟁점을 넘어, 학회와 학술교류, 그리고 비교법 연구가 갖는 의미를 다시 생각하게 하는 계기였다. 학회는 단순히 연구 성과를 발표하는 장에 그치지 않고, 공통의 문제의식을 확인하고 축적된 논의를 다음 연구로 연결시키는 지속적 학문 공동체로서 기능한다. 특히 정례적으로 이루어지는 국제학술대회는 일회적 교류를 넘어, 학문적 신뢰와 논의의 연속성을 제도적으로 담보한다는 점에서 그 의의가 크다. 이번 학술대회에서 확인된 생태환경범죄에 관한 논의는 비교법 연구의 필요성을 다시 한 번 분명히 보여주었다. 생태환경 보호라는 과제는 어느 한 국가의 법질서 안에서만 해결될 수 없는 문제이며, 각국이 축적해 온 입법 경험과 이론적 성과를 상호 비교・검토하는 비교법 연구의 과정 속에서 보다 정교한 형사법적 대응이 가능해진다. 그러한 의미에서 중국 형법학계와의 지속적인 교류는 한국비교형사법학회에 있어 특별한 의미를 지닌다. 이번 학술대회를 통해 확인된 중국 형법학의 이론적・제도적 발전은, 한중 간의 학술교류가 더 이상 일방적인 수용이나 소개의 관계에 머물지 않고, 동시대적 과제를 두고 상호 참조와 논쟁이 가능한 단계로 진입하였음을 보여준다. 이러한 교류의 축적은 비교형법 연구의 지평을 확장하는 동시에, 한국 형사법학이 나아가야 할 방향을 점검하는 중요한 자극으로 기능할 것으로 생각된다. 이러한 점들을 종합해보면 제23회 한중형법국제학술대회는 학회의 존재 이유와 비교법 연구의 가치를 다시 확인하는 자리였으며, 향후 한중 간 형사법 분야의 학술교류가 더욱 지속적이고 내실 있게 발전해 나가야 할 필요성을 분명히 보여준 회차였다고 평가할 수 있을 것이다.
Abstract
This article introduces and reviews the main discussions of the 23rd Korea–China International Conference on Criminal Law, held in 2025 at East China University of Political Science and Law in Shanghai, and examines the significance of academic exchange and comparative legal research in the field of criminal law between Korea and China. The conference is of particular contemporary relevance in that it selected “environmental crimes” as its main theme amid China’s ongoing institutionalization of environmental protection, including the release of the draft Environmental Code. The conference addressed a wide range of issues related to environmental crimes, such as protected legal interests, constituent elements, the relationship between punishment and environmental restoration, models of criminal legislation, and responses to transboundary environmental crimes. Through these discussions, the conference highlighted recent theoretical and institutional developments in Chinese criminal law scholarship. These findings also offer meaningful insights for reflecting on Korea’s environmental criminal law from a comparative perspective and for considering its future direction.
